Thank you Sandra for answering, spouse was US citizen we got married May 2015 after I came here with K1 visa, after abuse and police reports divorce happened in Dec 2015, applied VAWA by Nov. 2017, RFE and reply to RFE by June 2019 VAWA approved August 2019, currently waiting on my interview for AOS, so if I got my green card within the next 12 month and applied for a foreign spouse can I get in trouble even though divorce from the US citizen would be almost 6 years old by year 2021? Please let me know, and if you think I should wait until I become a citizen or if it is ok to do it once I get my GC , thank you.

You divorced  6 years ago then you are good. You can get married now, but do you  know that your wife won't be here before 2025 right?. After receiving the green card you have to wait  3 years to apply for Naturalization(if your ex wife is American),  then it will take 6/8 months for you to become a U.S. Citizen.

You can sponsor your wife being a green card holder, and when you become a U.S Citizen  you can update the visa category, but it will take at least  6 months for her to have the interview after you update her  visa category, then do the math. Explain this very well to your future wife, otherwise she will think within 1 ,2 years she will be here, and she will not!!!!!

I got 3 times before I-360 approval. Until I told them I feel like There against me and I’m frustrated and can’t bother anymore🤦🏽‍♀️  But I sent all they asked for none the less. Just keep sending it in and do numbering to make ur points not essays.

Please, what did they ask you to send in those 3 times?

Hi everyone,

I’m wondering if I’ll keep getting Prima Facie after I360 approval? My I360 was approved yesterday.

I’ve got 3 PF so far and haven’t used for anything but I see here people applying for FAFSA with it, so I was wondering maybe I could apply for a program.

No you won't be getting any more PFs! The upgrade is the C31 EAD! When you get that, secure your SSN then apply for the program of your choice.👍

@sandranj

I feel so sad and worry about a lot , who can be help me and give me some i got one arrest at 09/2019 due to have a argument and fight with my co-work. But No need any money for bail bond , not yet dismiss until 1/17/2020. But my attorney said will be dismiss just need take some time .

office in houston tx
PD date is :1/7/2018

my vawa approved on 8/21/2019

10/31/0218 got courtesy letter

if I get interview in few month later , but this case not yet dismiss, how can I to do ?

If in the interview how I tell to officer about my arrest ?they will be reject my green card or no ?

i am so worry about that .

help me please .i already waiting for my vawa interview long time 2 years .

i don’t want they reject my green card .

who have this type experience can you share to me how can I to do ?

You have to disclose and bring copies of arrest record to interview.  USCIS does not care that it is dismissed, they care that you told them.  There are no closed rescords for immigration.

Congrats

It was repetitive to me. They first ask to prove that the marriage was in good faith proof abuse proof we lived together. I sent emails and text messages and pictures then it wasn’t enough I got friends and family of his and mine to write to them then I sent in my letter from counseling and the letter from the child services I took my daughter for help. That’s when I got the ead

What do you mean with “secure your SSN”?

And can we get financial support for education with C31 EAD like they give with PF?

Hi, everyone, I have some issues and I would want you to help me out here, My spouse wanted to file tax last year and he asked me for my w2 and I told him that they hadn't given me at work, he asked the second time and I replied back that they haven't given me at work and he told me that he cant wait for me that he wants to file his own tax and he will file it married, filing separate and when I get my w2 that I should file MARRIED SEPARATE TOO, so when I got my w2, I file married , filing separate and the next day the office that helped me file the 2018 tax told me that IRS had rejected it because my husband had already filed married jointly, I was so furious because he never told me that he filed jointly because he didn't want me to know, we have been having our issues and problems but I didn't believe he needed to lie about that, he ended up adding me to the 2018 tax without my knowledge and there was nothing I could do, Dec 30th 2019 I got a letter from the IRS that we owe $1200 in taxes and they did the broke down, my husband file 0 income for me in 2018 and he knew that I was working , he also reduced his own annual income for the year 2018, now the IRS is saying that we are owing $1200 and we need to pay, I was so furious and I had told him not to ever add me to any tax no more now that we are separated, that we both should file separate but he disagrees but I am not giving him my w2,i don't know what to do now, I don't want him to add me to his tax, I had to sign up for Norton life lock because I don't want him to use my information to do anything shady, my fear now is that the tax he filed jointly in 2018, that is part of the documents I submitted with my VAWA petition, I hope nothing pop up, and I need your advice what do I do now with the letter from the IRS office, I don't want to report so he doesn't get arrested and probably goes to jail but am so scared that he doesn't do the same thing again, please advice me, I didn't know when he filed the 2018 tax jointly, the money he collected was not deposited to our JOINT ACCOUNT or any check MAILED TO OUR MAIL BOX, am still wondering how he collected that money, now we are both indebt of $1200 with the IRS, please I need your advice.

I mentioned several times here that VAWA petitioners don’t incur in public charge. There are several changes in the Law regarding  public charge, but the new Law  does not affect VAWA petitioners.

To file FAFSA you need a Social security number and the prima facie .

Thank you sandranj for your reply. Please another question that i need answer to: do i still have to request for prima facie renewal when mine expires in March despite having received work permit. Thank you

Filing tax return jointly will help you to

prove bona fide marriage so take it positively. And yes should have informed you about filing jointly before. You should consult cpa so that they can waive the penalty
