Hello everyone so I will mail today mv renewal request for my EAD and AP which will expire on May 2020. I have read on the USCIS website that C31 filers (VAWA petiotioners) are included on that policy where they will renew the EAD automatically up to 180 days, the proof that you filed for renewal is their receipts copy. Did this apply to anyone of you with your employer, did they accept it? Also, has anyone experienced after that 180 days extensions there's still no Green Card, will they extend the EAD again?

Your attorney is damn wrong.If your spouse is a U.S citizen you can file l485, l765 category C9 and you will get the work permit within a few months.I have one case  that USCIS just 3 weeks to issue the work permit.

You will notarize the cover letter that you will submit along with  form AR11.Keep in mind USCIS rarely updates the address ,they are messy.One week after mailing the change of address go to infopass to make sure they changed the address ok.

Legally speaking if your husband withdraws the l130 the AOS will be denied,and you will know if they deny the AOS ,but I have two cases the spouses withdrew the l130,but USCIS didn’t deny the AOS because both officers agreed to put on hold the l485 BEFORE the spouses canceled the l130.

 

I know the spouses withdrew the l130 because I received the l130 denial, but if you don’t have an attorney then your husband will receive the l130 denial,not you,and you will receive the l485 denial.

This is happening because the Automatic extension start the date after your EAD expires not a day or week before, so you have to go after it expires so the extension will be in effect and it will be show on the system.

Because USCIS mentions in ALL approvals about the priority date,but   just tGC holder’s spouses  use  the priority date to file l485.

Thank you for the response. Let's say if i go to interview first and officer decide to put the i-485 on hold then my spouse withdraw i-130. Will it gonna effect my i-485?

Thank you @sandranj for your answer. But my attorney doesn’t want to hear anything . August 2019 filler, no prima facie , no ead, no money , no work.

Sandra just told you above that she had two cases that the officers put the I-485 on hold before the spouses withdrew the i-130 and it did not affect their applications. So, to answer your question, it won’t affect your I-485 if USCIS places your I-485 on hold before your spouse withdraws their application.
