Priority dates never shifts. The officer handling your case will naturally wait for your response to continue with the processing of your case..your response depends on it. If you're married to a USC you can stop worrying about priority dates..it's only relevant to LPR spouses! The interim between when you received the RFE through when you respond may not affect your C9 EAD renewal..just the i360 as it's a different petition.πŸ‘Β  Please do confirm with sandra.

@Stillwinning!!!😊 did they ask u about getting food stamps at ur interview. My son was born here so I got food stamps for him.

It's still too early to panic..even though as at the time I applied for the petition, I got my receipt in two weeks. It's taking longer for some people these days..anywhere from 2-8weeks. Can be longer, so beΒ patient.πŸ‘

i am trying, it is just that i need that receipt number to have them hold them Β my i-485.

I have some questions about Vawa, I hope someone can clarify for me.

Β 

1) my prima facie expires on March 19th, 2020. Do They send automatically the extension or I should file something for it to be extended?

2) my Work permit Is till May 9,2020, it is under C09 (even though it came after my prima facie, I don’t know why they did it with this category, or it is normal?) When do I need to file for extension? Last time I filed for extension it took almost 10 months to get the card

Β 

3) I am in Community college in NYC, I filled out Fafsa, and today I got a letter that I received some scholarship from my college and also TAP grant. Is it safe to accept those awards? Can it be dangerous for my vawa case? I heard that USCIS doesn’t like people using governmental financial aid...Β

If anyone can help me and reassure or warn me, please, I would really appreciate!

@sandranjΒ Β what would you think of this? The letter for additional evidence did not have any deadline and was received back in Dec 2018. I filed I-360 and I-485 in Nov 2018. Awaiting for EAD renewal now and am worried. Initial EAD C9 was issued without issues though this letter was not responded.Β

Working with my lawyer now to finally reply to it.

1. yes they automatically renew prima facie. but you can also ask for renewal in writing

2. yes it is common. I received c09 as well after filing vawa. And you can renew it now

3. I do't know about FAFSA so no comment on that

on questions number 3. Vawa applicant are exempt fromΒ the Public Charge rule. Meaning you can take Financial Aid, Grants and Scholarship and it will not affect neither your VAWA case or AOS.Β

1) Since you're obviously benefiting from it, do request it upon expiration as opposed to waiting for automatic extension.Β

2)We are able to file for renewal 180 days prior to expiration. So I suggest you do so now! It's taking longer tp process..the earlier, the better!

3)Congrats on the scholarship! VAWA petitioners are exempt from public charge, if that's your fear.

Please do not disregard any letter from USCIS whatsoever! Always respond to RFEs in a timely manner for the smooth progression of your case. I suggest you respond to the RFE ASAP!πŸ‘

You can still ask the officer to hold it and that you just filed for VAWA and waiting for the receipt notice. A copy of the petition might help to convince the officer. Most people have been able to do exactly so. I pray you get it before the interview date though..πŸ™

Working on this now. My attorney's assistant was hesitant to replying. I am pushing her to reply asap now. He was just telling me that CIS sends not necessary RFEs if provide too much info.
