Hello everyone

sorry if i am posting it in wrong forum. Okay i will explain from the start. Came here in US on b1/b2 visa and got married to US citizen. My ex husband filed my i-485  but after his so many threats and abuses i left the house but before i could even think about anything he withdrew my application. N i became out of status that time. In August 2019 i applied vawa through attorney she filed i360,i765 and i485 . I done my biometrics shortly after that. N they sent me RFE for good moral character and good faith marriage and been sent away in December. I didn’t get any prima facie yet. I just emailed my attorney today to ask her how long can it take for my EAD to arrive and she gave me a big shock telling me that my ead category is c31 not c09 cuz i was out of status so that’s y she couldn’t do c09 . She said my i360 needs to be approved in order to get EAD. N i know it is taking nearly 2 years now to get that. And I don’t have a single penny on me right now. Just wanted to ask that did my attorney do the right thing? Could she Applied under c09?
if not then probably i have to go back to my country bcz cannot survive here like this. Sorry for a big essay i wrote n thank you in advance

What did you submit as good faith marriage and good moral character

I did send police clearance from my local county here and from the country i lived back in years as well (even both of these documents were sent with initiall package as well. For good faith marriage i only sent lots of pictures of wedding ceremony n pictures with my husband and his family. I did send letter from family and friends whoever did attend our wedding. Letter from the place where our wedding ceremony took place( traditional wedding, m indian so) . My marriage only lasted for 6 months and he never included me in any of the insurances , bills, or anything at all . So i sent whatever i had.

guys i have a question.

I applied for Vawa, i have form i130 and i-485 pending. I have moved out of my spouse's house.

my question is how would i know if my spouse have withdrawn the form i-130? Is there a way i find out?

You would get a letter in your adress or you would see your case status online denied. I do not think nobody is gonna call you.

It takes about a year to get any news from USCIS that your I130 has been withdrawn, your sponsor and ex-lawyer will get the letter.

it happened to me...

The court will walk you through, when someone is not found you will have to do newspaper announcement if is not responded they will continue with the divorce and divorce you. Depending on your state.

hi im a long time follower from past threads but haven't had the chance to be active. I recently received  my new prima facie and its only valid for six months, the previous one was for a year. I filed in November 2018 does this mean they are making a decision soon ? and is this a good thing or bad thing. because If theyre denying me they wouldn't give me one valid for a year

Thanks for the reply.

How would this effect me if my spouse withdraw i-130. will my i-485 still be pending or it would deny?

Since it took a year for you, were you able to renew your EAD?

I don't think the duration of prima facie has anything to do with when your case will be approved. I believe it's issued based on the discretion of the issuing officer. I say this because 3months after I was given a one year prima facie, my i360 was approved. Still it makes sense to assume that the officer believes the case can be processed within that time frame!💁 we've seen June July and August 2018 approvals..so you're not far off! Wait for it.👍

Uscis is not obligated to issue RFE anymore, it’s discretionary now .Tell your attorney that she/he should read more often about  the U.S Immigration  Laws.

Thank you, Sandra and God Bless You!

Would you know if initial request for evidence puts my case on hold and my priority date will basically shift by the time I am replying to this RFE. This is not the official RFE (not Notice 797E with details of what CIS needs) but just a letter to provide more evidence to get prima facie. Also, will this affect EAD renewal?
