I’m at the social security office my new ead card now says my maiden name not the married last name so they said I can’t get a card because my first card was in my marriage last name and if I try to get a job I can’t be verified by social security so I won’t be able to get a job.

You need to turn in the documents to Social Security as to why you changed your name to maiden name, such as divorce court records.  You cannot just change your name without legal reason.

So if u get public assistance u might get a denial? Didn’t the prima facie day u can get federal Bennett’s. I got it for my son for a few mths he was born here. But never got it for myself.

A Vawa petitioner can get public benefits,it’s not a problem at all.

@sandranj

i have an attorney, yet having to seek advice from you as i sometimes donot get timely advice from them. Here is an important advice i need to respond to my rfe. Please help.

My attorney is yet to receive the physical rfe notice. I am assuming it would be for my birth certificate as my lawyer forgot(!) to include it in the original packet.

A qq occurred to me. My birth certificate is bi-lingual ie. in English AND native language. Would USCIS need certifed translation for it as its not plain English and has 2 languages?

Thank you 🙏

If the birth certificate is in English and in your native language then you don’t need to translate.

I do understand that everyone journey is different and the wait for us so long.  I will persevere and will not give up.  Ms Sandra @sandranj can you please direct me is there a way for me to contact you for your service, thanks.

I am sorry but I don’t get cases that I don’t start from the beginning .

TO prove abuse you will need to attend therapy, and have a psychological evaluation done. Don’t get the evaluation done before attending at least 5/7 therapy sessions.Good luck .

I don’t have divorce papers. I just filed using my last name when I did vawa which is why the card came in my maiden last name

Hello everyone

sorry if i am posting it in wrong forum. Okay i will explain from the start. Came here in US on b1/b2 visa and got married to US citizen. My ex husband filed my i-485  but after his so many threats and abuses i left the house but before i could even think about anything he withdrew my application. N i became out of status that time. In August 2019 i applied vawa through attorney she filed i360,i765 and i485 . I done my biometrics shortly after that. N they sent me RFE for good moral character and good faith marriage and been sent away in December. I didn’t get any prima facie yet. I just emailed my attorney today to ask her how long can it take for my EAD to arrive and she gave me a big shock telling me that my ead category is c31 not c09 cuz i was out of status so that’s y she couldn’t do c09 . She said my i360 needs to be approved in order to get EAD. N i know it is taking nearly 2 years now to get that. And I don’t have a single penny on me right now. Just wanted to ask that did my attorney do the right thing? Could she Applied under c09?
if not then probably i have to go back to my country bcz cannot survive here like this. Sorry for a big essay i wrote n thank you in advance

@sandranj this was my question.. thank you

Why I130 priority date is mentioned in I360 approval notice?

The priority date Is usually transfer, when you applied to the I-130 previous to the I-360.... But this is jut useful to LPR Spouse, so when they adjust status don't need to wait anytime or less time.

Name on immigration document and other evidence for an SSN are different -

If the required documents show clearly different names, do not accept the evidence to process the SSN application. In these situations, the applicant must submit SSN evidence showing the same name or submit evidence of a name change after the immigration document was issued per RM 10212.010.

What was the timeline experience for you recently on receiving the renewed EAD under C09 when I-360 and I-485 were filed concurrently? How soon has it be renewed / received? Thank you a lot all!!!

You MUST renew 4-5 months before it expired!

it takes over 9-16 weeks to get the renewal 😣
