Get with Shroy I think he was in same situation as you previously. He'll put you through. @Shroy123 please guide Sk1992 it would be beneficial. Godbless. Also when Sandra comes through she'll give legal advice as usual.👍

I received the initial RFE for good moral character and good faith marriage inorder for them to determine prima facie. They didnt specify a deadline. I chose to reply and send more documents.

About two weeks after I send a response. The status changed to "...we received your response to our Request for Evidence for your Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, Receipt Number...... USCIS has begun working on your case again. We will send you a decision or notify you if we need something from you....".

Before I responded to the initial rfe. My status read something like they will not work on my case until they receive a response to the RFE and the days from the time they send the rfe continued counting. After I send the rfe they updated my status to response to rfe received. I haven't received a prima facie yet. Hopefully I get one soon. It's still early to get worried. Its been less than month since they received my response.

If you can still respond to their initial rfe i suggest you do so. I dont think its wise to fail to respond to any letter from uscius. What if this prolongs your case processing?. Please work on it. Since they never gave a deadline I suggest you work on it.

I listened to my lawyer. They tell CIS sends it to everyone and no need to respond as will cause only more scrutiny. I don't know. Hard to get lawyer to do anything as she has "higher" priority deals. Worrying me a lot.

Why did you choose not to reply to what they ask for?

In my opinion, that was risky

my lawyer initially said no need to rush as there is no deadline and CIS sends it to everyone. Couple months ago she said its rough times in immigration now and better to sit tight. again i have anxiety about this. I dont know maybe I should just respond myself. I paid lawyer and now she is just being slow on anything

Thats what I tod @Sk1992 that my attorney made that same mistake but however i received c09 ead within 3 months. There is no harm in applying for another I765 based on pending i485 so that you can get it on time

Oct 24, 2018: refiled I-765 (category C-09)  with $410 filing fee

Oct 31, 2018: I-765 NOA received

Feb 26, 2019: 3rd Prima Facie Received

Apr 01, 2019: EAD (category C-09) approved

Apr 03, 2019: EAD card and approval notice received

Jun 07, 2019: I-360 new card being produced

Nov 25, 2019: Interview notice received for Dec 16, 2019

Today: I-485 approved, card in production

The interview was very formal, I took my attorney and honestly I didn’t need her. Well let me not say that because I don’t know what they would have tried to ask if she wasn’t there. Anyways the IO only asked me the yes/no question including whether I’ve accepted public benefits such as food stamps. Then she asked if I’ve changed back to my maiden name and where I’d like my card sent. My medical wasn’t completed for the interview due to the holidays so the IO said I have to send them in first. I sent in the medical on Monday and it was delivered Tuesday and today I got the good news guys.

Thank you and God bless you all

Congratulations 🎈🍾🎉🎊 welcome to America

No they dont send it to everyone. I have seen people here who have received prima facie directly without receiving the initial rfe.  If I were you i would be worried. Your lawyer doesnt seem to be working at your best interest. If you read what has been posted here recently by immigration attorney Sandra that uscis are not obligated to send rfe anymore. What happens if your lawyer ignore this and you get a denial without the chance for rfe. Think about it. If you can send it yourself. Or have a serious talk with your lawyer and ask him or her respond to it. Tell him to read the info Sandra posted here. Check that link.

hello every one,

I have a pending I-485 from ex marriage, my combo card was expired last July, do I have to pay for the renewal ?

thank you

With a pending i485, you do NOT have to pay for renewal. But few petitioners here has experienced different. Most of us have NEVER paid for it. My most recent renewal from just 3weeks ago and previous ones wasn't paid for!💁
