I just emailed my attorney today to ask her how long can it take for my EAD to arrive and she gave me a big shock telling me that my ead category is c31 not c09 cuz i was out of status so that’s y she couldn’t do c09 . She said my i360 needs to be approved in order to get EAD. N i know it is taking nearly 2 years now to get that. And I don’t have a single penny on me right now. Just wanted to ask that did my attorney do the right thing? Could she Applied under c09? 
if not then probably i have to go back to my country bcz cannot survive here like this. Sorry for a big essay i wrote n thank you in advance

file a new i-765 under c09 with a fee waiver ! Your lawyer is evil ...how are you going to survive ?!

My attorney did the same thing. when he filed my initial package for vawa, he included c31 instead of c09 but i received c09 after three months of filing. I think uscis can consider c09 if you submitted i485 along with i360

now there is nothing new from USCIS regarding my case .. it’s been 23 months now since i filled i360 .. iam February 2018 filler and i can see June and July approvals ! 
Could my duration of stay affect my case decision !! 
any advices !? 

I am sorry for your loss.. i dont think it would affect because i know someone who stayed 3 months on AP outside US

She just rung me n she kinda got so angry on me for emailing her about this. She said every case is different n i know what i m doing. Made me cry literally

Oh i hoping if something like this happens with my case? If possible can you please tell when was your case filed? N were you in your status the time you applied for vawa. Because this is the reason she says she did apply for c31 bcz i was out of status

No. i was out of status as well.. and i filed on Dec 2017 and i received first ap/ead on March 2018 under category c09

I think priority date differs for usc and gc spouses ,when they file concurrently with I-485, I-765.

 

if you file standalone vawa , the priority date will be same for gc and usc spouses.

 

gain if u got pending I-130 , you priority date changes to vawa.

Now it all depends on your case and the type of evidence you provided . When I filed my application I put c31 to play safe  and I didnt know that I could apply under c09. . I doubted my evidence but these were all i had so I still filled c09 two months later praying for a good outcome.  I would suggest you to write to sandranj . She is an expert on vawa cases and she will direct you properly and give you a second opinion too !

Yes , with Advance parole it’s almost normal for indoor inspection, so keep that at the back of ur mind.. the usually take AP  holders for inside office inspections ask some few questions then they allow u go...

Hello how are u? You have to apply for a Canada visa , I can’t go to Canada with Advance parole , u can only reenter the U.S with Advance parole , so u have to apply for visa .. pls read from page 50 down to 70 on this site u would see where I narrated how I applied for Canada visa and travel and came back... so u get to understand it better
