The priority date is applied and necessary when you are going to file for the Adjustment of status (I-485) it has to be current in order to do so, since your spouse was an LPR you need a visa to adjust since is base on family visa category not USA citizen immediate relative, the priority date will not make your I-360 process faster or slower. 

 

As long as your I-485 is still pending and valid, and your EAD (working permit) and Advance Parole (travel Permit) are renew you can use it... you don't need to wait for Vawa to be approve to do so.

Vawa is taking around 18-24 months.... so have couple months ahead of waiting.

I-765  taking 5-8 months  (just make sure the EAD was category C09 not C31, if so you will received soon)

have anyone receive initial request for evidence for prima facie (good moral character and good faith marriage) with NO deadline and did you reply to it? I got mine a year ago and still did not reply. Will clock stop ticking until after I provide a response? Again, it's not like an official RFE (Notice 797E and etc). Just a letter. Usually official RFEs are detailed and specify what exactly CIS needs. This letter is different.

Why did you choose not to reply to what they ask for?

In my opinion, that was risky

Regarding your EAD renewal you should sent it ASAP, since is taking 5-8 months, as soon as you received your Renewal receipt you can show to your employer since is proof of your 180 days automatic extension. 

Thank you for this info. Can I also renew my Advance Parole? Also, do you know what form numbers I need to fill out? Sorry I just saw your message I have been working too much.

I received the initial RFE for good moral character and good faith marriage inorder for them to determine prima facie. They didnt specify a deadline. I chose to reply and send more documents.

About two weeks after I send a response. The status changed to "...we received your response to our Request for Evidence for your Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, Receipt Number...... USCIS has begun working on your case again. We will send you a decision or notify you if we need something from you....".

Before I responded to the initial rfe. My status read something like they will not work on my case until they receive a response to the RFE and the days from the time they send the rfe continued counting. After I send the rfe they updated my status to response to rfe received. I haven't received a prima facie yet. Hopefully I get one soon. It's still early to get worried. Its been less than month since they received my response.

If you can still respond to their initial rfe i suggest you do so. I dont think its wise to fail to respond to any letter from uscius. What if this prolongs your case processing?. Please work on it. Since they never gave a deadline I suggest you work on it.

Hello how are you? I just came back from Canada few days ago , I use my Advance Parole and it was cool... so far so good no body here has had any difficulty reentering the U.S with their AP

Hello everyone 

sorry if i am posting it in wrong forum. Okay i will explain from the start. Came here in US on b1/b2 visa and got married to US citizen. My ex husband filed my i-485  but after his so many threats and abuses i left the house but before i could even think about anything he withdrew my application. N i became out of status that time. In August 2019 i applied vawa through attorney she filed i360,i765 and i485 . I done my biometrics shortly after that. N they sent me RFE for good moral character and good faith marriage and been sent away in December. I didn’t get any prima facie yet. I just emailed my attorney today to ask her how long can it take for my EAD to arrive and she gave me a big shock telling me that my ead category is c31 not c09 cuz i was out of status so that’s y she couldn’t do c09 . She said my i360 needs to be approved in order to get EAD. N i know it is taking nearly 2 years now to get that. And I don’t have a single penny on me right now. Just wanted to ask that did my attorney do the right thing? Could she Applied under c09? 
if not then probably i have to go back to my country bcz cannot survive here like this. Sorry for a big essay i wrote n thank you in advance

Hello, you better respond to it really quick becos u just stopped ur vawa process time  with ur own hands....

Just  Very werried if Employer want to see physical GC or Make copy of it .

I stand corrected. if you give them your state ID and Social security card ( which does not have  a restriction stamp on it) they can not demand to see your GC. If you give them your GC alone,  they can not ask for your state ID and/or  social. So yes, if you don't want to show your employer your GC you don't have to.  I was just reading up on this today.
