Hello everyone,

 

I recently read about RFE not required.

I filed Dec 2018.

I was required initial evidence which was police clearance and was sent in promptly.

I did not submit any additional document at that time because I was still going for Therapy  and also medication management for PTSD.

I have most required evidence now but waiting for RFE.

I'm confuse now, should I continue to wait until they ask, or send every supporting document without waiting for RFE, please I need advise from everyone and @sandranj, Also, my EAD expires in March 2020 and I just got finger printed for the renewal.

 

Please Help!!!

Hello save you self the time , kindly send all the evidence you have in to USCIS gather all and send it no need to wait for RFE...

Hi dear, my packet of vawa was sent on july 29th and they received it on August 1 but i did get my reciept nearly by end of august . So don’t worry it takes around a month’s time. I know the feeling , i am also waiting for my EAD through vawa. August filler . I think you can call immigration and ask them about your case and tell them that you want to hold your previous application.

I posted this here MANY TIMES, USCIS is not obligated to issue any RFE,they can deny without asking anything.

Your attorney should learn about immigration Law, tell him please to read the USCIS memorandum PM-602-0163 issued on July 13,2018 where clearly USCIS  states that  USCIS can deny any application without issuing a request for evidence. Their decision is discretionary now, it's not mandatory anymore to issue a request for evidence or a NOID.

yeah she probably did put it in c31 sadly. I'm not sure if she kept a copy of her i765. Her lawyer was the one that did the filing mostly i'm sure.

USCIS doesn't have to request anything, they are not obligated to issue a request for evidence.The person can submit documents how many times they want prior to adjudication.

Receipt can take up to 3-8 weeks to received....

If the person gets married while in removal proceedings the burden to prove a bonafide marriage is much higher. We have here on VJ many stories of AOS denied because they got married while in removal proceedings.

 

I met one guy here on VJ, he had his VAWA denied, he got married after having been placed into removal but USCIS denied twice his AOS.He has 2 children with his current wife.I didn't accept to represent him because I know how  difficult is to have the AOS approved.

Do not wait for an RFE, they are not obligated to issue anymore, If you have more substantial proof for your Vawa case please sent it, with your I-360 receipt or the Blue notice that comes with prima facie, Ask your lawyer to do so, my lawyer had the same thinking and I told them it is my case and it wont hurt to sent more proof and I demand for them to sent what i had extra, -_- and my case was approved without any future RFE...
