i applied in 2018 but didnt get a chance to visit. My passport is expiring this june 2020 so for me it was only 2 years. they issue a visa based on passport expiration date

You need to take into consideration that DACAis still valid,therefore your EADΒ is valid , but in June the Supreme Court will review DACA and if they decide to cancel DACA thenΒ your EAD won’t be valid anymore,Β and to file a new EADΒ takes 7/9months.

I checked some copies of the Β NISI ABSOLUTE DECREESΒ that I have here, IΒ found 5 and all Nisi Absolute decrees are exactly like the one he posted here.All my cases were approved already,they didn’t have any problem .

i just couldn’t see the top and the bottom of the Nisi absolute but it must have the chief registrar signature and the Court stamp as well.

I just found 3more and it’s written β€œCertificate of decree absolute”, maybe the IO is used to see this kind and not the one he submittedΒ s because the cases I mentioned Β are old cases tho, or in Nigeria they changed the decree style .

I didn't see a signature or seal either, that is why I suggested that they get another document.Β  USCIS most likely didn't see it either.Β Β

Two months after the interview, I received an RFE asking me to prove my marriage was really null and void from back home . I sent in the final divorce documents and court papers showing my marriage was really done . And USCIS received it and about 8 months later I received another RFE asking me for the same thing but that they needed a more better evidence showing my marriage was really legally done from back home . i sent it in and it took over 9 months and I received another letter from USCIS saying my applications were cancelled and I was given 30 days to leave the country , January 13th 2020 makes it 30 days actually.Β

These put a big strain on my marriage here since after the interview. My wife made me leave the house and pay rent too while outside and threatened to divorce and call immigration on me . It’s a long long story of ill treatment after the interview from my wife .Β

I was asked to refile my AOS and prove my divorce from back home by two attorneys. But, my marriage here is very shaky and on the verge of divorce. What’s the probability that she won’t leave when I refile the AOS.Β

Am resorting to Vawa because I was so traumatized after that interview by wife here. Since I’ve been asked to leave the country, Will this affect my vawa if I file for one .Β 

Of course it will affect your VAWA case.

Considering what you posted here you don’t have a VAWA case.You are traumatized because USCIS asked you to leave the U.S,and this is not ground for a Vawa case,and even if you have a VAWA case you still need to prove in your new case what USCIS asked you to prove before .

Look having a marital conflictΒ Β isΒ not a reason to file VAWA, and it’s not a way toΒ avoid removal either.Β I am handling Vawa for years and when someone is abused the person mentions about the abuse or he/she says I am beingΒ abused. You will need a miracle bro.

Thanks for your response. There’s still an option of an appeal which the lawyer just put in to reopen the case .Β

Is better to be secure and file C9 EAD, since DACA future review / decision will be in June,. and is uncertain what will happen,.Β

They just basically go over your i485 to ensure everything is in order..majority of the times, it's approved on the spot..other times it undergoes further review which can take months...do your part, make sure your medical is updated, all pre-requested RFEs turned in..you should be fine.πŸ‘
