You’re right and that’s my fear but my intentions are very real .

And USCIS received it and about 8 months later I received another RFE asking me for the same thing but that they needed a more better evidence showing my marriage was really legally done from back home . i sent it in and it took over 9 months and I received another letter from USCIS saying my applications were cancelled and I was given 30 days to leave the country , January 13th 2020 makes it 30 days actually. 
 

These put a big strain on my marriage here since after the interview. My wife made me leave the house and pay rent too while outside and threatened to divorce and call immigration on me . It’s a long long story of ill treatment after the interview from my wife . 
 

I was asked to refile my AOS and prove my divorce from back home by two attorneys. But, my marriage here is very shaky and on the verge of divorce. What’s the probability that she won’t leave when I refile the AOS
 

Am resorting to Vawa because I was so traumatized after that interview by wife here. Since I’ve been asked to leave the country, Will this affect my vawa if I file for one . 

Also you can wait for sandra the attorney here to give you good legal advice! You have to listen to legal advice now..NOT emotional advice! Adjustment of status is the goal here...USCIS questions the validity of your marriage already..this is quite a situation!

Its a format for those whose AOS has been denied. the same thing was written in my AOS denial letter when my ex wife withdrawn my petition. Although I had approved I130. But yes there was no deadline written on my denial letter. I panicked as well.. and then I filed for vawa. I would say submit your petition as soon as possible.

 

Also, if you have an option to file MOTR, do it and submit your divorce documents again.. and then file for vawa. Just my 2 cents 

I think I’ll do that . File a motion to reopen and then file for vawa too .

Thanks for seeing things the way they are..I'm usually a cheerleader here LOL..but after reading your situation, it really needs legal attention! Sandra will definitely tell you what she thinks..her opinion will go a long way. For now don't attempt anything that will further put your case into surveillance!💁

Switching to vawa won't make any difference u still required to prove ur previous marriage divorce decree with vawa as well think well before u make any decision

Your marriage green card could've been approved but because of the misrepresentation about your previous marriage they denied your AOS

exactly. there is something which was missing. did you try to get in touch with your ex spouse in your back country? It might helped you.. means a statement from her side or something like that. Or you could have submit any documents showing she is already married or something like that

Inorder to annual a marriage your husband must prove that he or she has the grounds to do so and if it can be proven. Common grounds for annulment are for example. Fraud, Duress, threat, or force, Bigamy, Mental incapacity, Inability to consummate the marriage, underage marriage etc. You  can contest his grounds in court. He will have to prove his grounds. Concerning the affidavit of support. If you already applied for vawa then I dont think you need it. This is because vawa applicants are exempted from affidavit of support. Anyway what makes  you think he wont withdraw it after you devor ce?. If he is threatening you to withdraw it now. He can also withdraw it afterwards when he has got what he needs. Not unless you need this for something else I dont think you will need it for vawa. And if you already applied for vawa you cannot be deported. You can wait for the vawa decision while in the USA. 

 

About mediation costs. It's all depends. In most cases you split that half. This can be also split according to how much each of you earns. I think you should ask your free lawyer how this works. He should be able to answer your questions clearly and point you to what's best for you. 

 

Before you give in into his threats and do something you might regret I think you should consult your lawyer or if you dont feel he or she is working to the best of your interest. Do find someone else to consult with.

Our marriage was real and even if he would like to make up some story about fraud our friends and texting back and forth  with his mom about how we will be happy to finally get together will prove that it was real. 

But unfortunately even after what he did he can’t stop making me hurt.

He just want to destroy me. Especially mentally.

 

About withdrawal I was worrying that once he will do it I can’t stay here anymore.

It was the only one wish he want to accomplish.

I don’t know why they are doing this with us.

Make is love, have faith, have hopes.

Start to build plans for the future. Babies, future together. And than just kick off from their life. And afterwards even keep blaming  and insulting  more🤷🏻‍♀️

 

I tried to catch my attorney and have at least some dialogue but he all the time busy and since he is not charging me I’m trying to stick out to him. And he is a good attorney but I don’t know why he don’t want to help me.

Maybe because he knows very good my husbands attorney. 

Idk.

Anyways I’m trying to stay calm.

We will have mediation on Monday.

Its a second one. 

It will be rough I know already. 

And also I know that they will threatening me even more.

This same situation happened to me, the police department referred me to a therapist that works directly with domestic Violence victim Safe Horizon i went several months me and my daughter the therapy really help us i will say my daughter change in a very good way after that, but it was NO USE for Vawa purpose she only made 2 pages evaluation she did input the treatment she use, our diagnose, and the recommendation and referral to continue therapy... she detail everything she did but  I decide to sent it anyways with Vawa because I also have  police report, 2 order of protection one criminal and second order of protection was stay away from the family court.. So i really did not need it. 

did you have any picture from the abuse? did your spouse attack you? how can you have police report?
