Happy New year dear. The holidays may have affected it in some way..usually the letter comes one month after approval. No worries there..you should get it this week or next!👍

I am also waiting for my approval letter. My c31 was approved on Nov 13th

Im divorcing with my husband.

So. To make long story short I will just say that he has a food well paid attorney.

Mine working with me for free. He doesn’t charge me.

But. He don’t want to fight for me. I don’t feel any protection and help.

We has one mediation with my husband. It didn’t finished in that way as my ex and his attorney would like to finish.

We will have one more January 6.

But they are threatened me. His attorney said that he will do it not pleasant for me. If I won’t collaborate😱

I told them that  I’m not afraid of them and just left.

 

But. Unfortunately my ex knows my weak bottom-money.

I have a child and I’m not making a lot.

So he is pushing on me telling that he will put all court  charges on me. And that I will be paying mediation as well. Even though he knows I can’t pay it.

He is threatening that he will withdraw affidavit of support and annual our marriage.

 

What can I do in this situation?

Can he do all this things?

 

1. Can I somehow get waived this charges?

2. Can he withdraw affidavit?

3. Can he easily cancel our marriage?

Sorry to hear about your situation.

Inorder to annual a marriage your husband must prove that he or she has the grounds to do so and if it can be proven. Common grounds for annulment are for example. Fraud, Duress, threat, or force, Bigamy, Mental incapacity, Inability to consummate the marriage, underage marriage etc. You  can contest his grounds in court. He will have to prove his grounds. I think you should be worried about this only if you know or suspect he has something on you that he can use to prove any of the grounds for annulment. Consult your lawyer. 

 

Concerning the affidavit of support. If you already applied for vawa then I dont think you need it. This is because vawa applicants are exempted from affidavit of support. Anyway what makes  you think he wont withdraw it after you devor ce?. If he is threatening you to withdraw it now. He can also withdraw it afterwards when he has got what he needs. Not unless you need this for something else I dont think you will need it for vawa. And if you already applied for vawa you cannot be deported. You can wait for the vawa decision while in the USA. 

 

About mediation costs. It's all depends. In most cases you split that half. This can be also split according to how much each of you earns. I think you should ask your free lawyer how this works. He should be able to answer your questions clearly and point you to what's best for you. 

 

Before you give in into his threats and do something you might regret I think you should consult your lawyer or if you dont feel he or she is working to the best of your interest. Do find someone else to consult with.

Happy new year to you too dear.  Shroy123 had his c31 approval since Nov 13th, 2019 which is about 2 weeks before mine and still no update in his case from vermont as well. How about, I wait till January ending and if i still don't get any update from Vermont then i contact my congressman to inquire on my behalf. That should be a good plan right?

I’m very confused. I withdraw my i-485 petition before my interview with my abuser. August 2019 I filed my vawa and a new i-485. I never received a receipt for my previous i-485 regarding my withdraw letter. I just received an RFE regarding my new i-485 saying that they could not process 2 i-485. My attorney answered the RFE and after that they sent the receipt for my new i-485. On Friday my previous attorney (who applied for my green card based on marriage) sent me a Reopened Notice for  I-131 and the notice was addressed to my abuser. The Notice says that the case was reopened and they are reconsidering the decision previously issued (???). I don’t know what they are talking about. Why they are mailing my abuser???? @sandranj can you help me?

About charged I meant just charges for divorce.

He told me that he will pay for divorce somewhere around 20000$-40000$. I don’t know if he is telling a truth or just trying to make me scared and just sign a papers. But he gave a hint that I will pay half of it.

He filed for divorce.

 

 

 

About affidavit. He was scaring me with this all the time and he just keep doing this.

Like if he wants he will withdraw it and I will be immediately deported. 

Thats why I’m trying to find information about this. Just to know if this is a truth or he just want me to sign a papers.

 

He can withdraw the I-864 anytime he wants, considering that you don't have a green card.

Only he can do it, I checked online and I see that it’s still pending. Is it going to affect my Aos once my Vawa is approved? I didn’t file for AOS yet because I have a witholding of removal so I have to wait till my Vawa is approved before filling the AOS

Forget about the I-130, your  I-360 replaces the I-130.
