Hey GiGi, prima facie is not an approval! It just indicates that your documents are in order or seem complete before it is properly adjudicated! You can receive prima facie up to 4 times or more before VAWA approval..it all depends on the pace of the officer and the complexity of your case! You mentioned you received a card..it has to be the C9 EAD. When your VAWA is approved, you will get the C31 card. Also an approval letter basically confirming your i360 has been approved! I hope this helps..also try to read previous threads it will help with any confusion you may have at any point!😊👍

Wow.Thank you so much still winning. I never really got a full explanation. I appreciate u. I have one last question if I did I-485 under my husband petition. Will I have to re-do it under vawa. Because under his petition I went to the interview alone but the interviewer said he would not cancel it so it’s still there like I never showed up which is what he explained so is it still valid (the I-485) or I need to send one in to vawa? My last update is a that they mailed the card to me under the i-130 receipt. Which I will receive this Monday

Let us know when you receive it! If you asked the officer to hold the i485 until your VAWA is approved, then it will still be valid and you will have no need to file a new one! From what you stated here..the officer said he won't cancel it..so my thinking is that you're good!😊👍

And @Gi Gi, it doesn't have to be a last question..😊 whenever you run into confusion, we are always here to help. Sometimes others are busy with one thing or the other..and may just throw in a few words..maybe not detailed..but they still mean well. Most times they return to give detailed responses. If you are renewing your EAD then put "AOS PENDING".

If the IO put your AOS on hold then you don't have to refile a new I-485.

Applied on March 2018

RFE receive on September 26

I send on December 20

They might take 60/180 days to give the decision, and I saw cases here of people waiting already 9 months.

I don't understand which waiver you are talking about, you can file I-360 along with the AOS.

 

Did they  mention in the denial  that you entered into marriage to circumvent  immigration Laws? or mentioned something such as  " sham marriage" or "fraudulent marriage",if yes then you won't have your new AOS approved.
