how do you check the change of address through congressman??? I hear this for the first time. What's the process?

Oh easy. They can help you enquire. Just like they help us on a number of issues..they can do this too. Google your congressman and hit them up.☎

Do you know anything about what to do if you getΒ a denial notice for your I-485 application?Β Per the denial notice, the reason given is that I failed to attend an interview scheduled back in Nov 2019. But, I never received or was informed about any interview appt notice. Per the USCIS website, my I-485 application is still pending. No mention of an interview notice at all.Β As per the case status update, the latest information they have is that my fees were waived.Β 

The question is what is the probability that this denial notice was issued by mistake?Β 

My current options appear to be: 1)Β contact Ombudsman, 2) appeal the decisionΒ withΒ the USCIS Appeals Admin Office and 3) re-file the I-485 application?Β 

I would appreciate anyone who can give me adviceΒ regarding any fixesΒ and howΒ  I canΒ get through this hurdle?

Response my senator received from USCIS when inquired about my I485. And after that, I received RFE.

Β 

"The NBC serves as a central facility for the pre-processing of Forms that require an interview, such as I485s and N-400s. Your constituent's form I-485 was transferred to the NBC from the service center for regular adjustment of pre-processing

Β 

Once the field office schedules this case for an interview, your constituent will receive an interview notice stating the date and time to appear for the scheduled interview. Once the interview is scheduled, the NBC will then forward the file to the field office"

I hope with you that it was given by mistakeπŸ™..but I think not. The status we see online doesn't always give real time situations of our cases. Most people that haveΒ been in your situation re-file. So is it true you didn't attend interview to even ask them to hold it? Pending VAWA approval? If yes then it truly is denied. The officer likely interpreted it as abandoned..so their next line of action is to deny it. It's faster to go with the 3rd option as the other two could waste time..really waste it!😏

take a screenshot of USCIS website where it shows no status change. Also, file MOTR and explain you have never received an interview notice. They should open your I485 again

@namastenycΒ that is just my opinion. But this situation should be taken seriously..you need legal advice not one based off of feelings and thoughts..ask Sandra to direct you. My advice was based on previous threads..and I believe I've read Sandra mention it's easier to file another!πŸ’

Hi dear, and family,

I just received this letter, stating that my I-765 is denied, it was marriage basedΒ Β renewal, but since marriage case doesn’t exist anymore and my lawyer had already filed a motion to reopen it,

Q 1, is it going to affect my ap and ead application that, the lawyer filed on November 2019 and they took fingerprints on Jan 2020,

or they gonna deny vawa based petition Β as well, I’ve been freaking out for awhile any reponse and guidance would be really appreciated,

You have an attorney..I only hope he or she is directing you rightly. If your i485 is denied..like USCIS stated, you have no business filing i765 as it is not a stand alone petition. It's more of the benefits of the principal form i485. USCIS is trying to make you understand that you can re-file, as long as you have a pending i485. I don't know why the initial i485 was denied..but usually people are able to re-file as long as fraud is not the reason cited for denial. I hope Sandra gives her opinon, as a legal angle/view is priceless!πŸ‘

And also except the motr is granted..I doubt if the petitions your lawyer filed will go through..if it's not based on a pending i485. Not pending re-open decision! Your i485 will not affect your VAWA case. If you get an unfavorable decision on the i485, you can always file a fresh one! So did your attorney file a new i485 or no?😏 if not he's just wasting time.

Thank you for your response, the reason for the denial was that, once my wife and I got divorced and My lawyer sent them the final decree of divorce before filing for vawa, at that my wife and had been seperated after an abusive period, I had left the the house no where to go, and then received, interview letter before divorce and then uscis, rescheduled theninterview and sent us appointment letter for my wife’s finger prints, few times and unbeknownst to me there was a court case pending.

He filed a new i485, I thinking in November 2019 but I’ll ask him for sure.

again as always, thank you for your response. And can I file i485 along with vawa ?

I always feel that filing a fresh i485 is faster than going back and forth with these motions to re-open. If you say your attorney filed a new one..I'm believing you will be fine. But then that's what he was supposed to do instead of the motr. So ask him what happens if the motr is granted? You can't have two open i485..I believe..one will have to be cancelled or denied by the officer. Not sure about the dynamics..just noting logically.πŸ’
