Why do they ask for that. And I see ur in Miami. My office is in Broward. Congratulations to u I just got my approval notification I got my ead in December. So I’m giving it 6 mths hopefully to get the greencard.

Hi guys please I need your help.

 

I just submitted VAWA and received receipt notice in mail a week ago. I have a pending i130 and i485  based on marriage went to interview and was told to submit receipt notice once vawa has been submitted. I wrote to them a month ago that I needed more time because I don't have the needed documents yet. Today got a letter that says my application got denied for the i130 and i485... I'm so worried please help me I don't know what to do.

Don’t be scared. File VAWA ASAP , you can file for a new I-485 along . Read previous threads. Are you using a lawyer?

I’ve already filed for VAWA and just got the receipt a few days ago. 
EDIT: Also I’m not using a lawyer and now I’m also meaning to ask if it would be a good idea to get one.

Don’t be scared I was in the same situation and last month my VAWA was approve. Since you didn’t file concurrently your I-360 and I-485 together , I think you can wait until your VAWA is approve and file the AOS. For the I-130 denial it’s “normal” don’t worry. People here like (stillwinning) are very knowledgeable. Never lose hope everything will be okay my dear.

That is also my problem... my ead will not be valid anymore :(

The same thing happened to me. I filed a new I-485, EAD and AP when the other got denied. Also sent a letter to my local office with the vawa receipt and asking them not to issue a NTA. So far, after almost a year after no NTA has been issued to me. And yes, your EAD is no longer valid so you need to apply for a new one asap.

08/2017 - Married USC

09/2017 - Application for I-485, I-765, I-131

12/2017 - Approval  I-765, I-131

09/2018 Renewal application for I-765, I-131

04/2019 - I-485 interview scheduled 

04/2019 - I-485 denied, husband withdrew

05/2019 - Application for  I-360, I-485, I-765, I-131 

12/2019 EAD, AP approval

07/2020 EAD, AP renewal sent to Vermont

10/2020 EAD, AP Approval

11/2020 VAWA I-360 Approved (C31 produced)

01/2021 I-360 status changed to case approved

03/2021 - I-693 deficient notice from national benefit center

I don't know, it was in my interview notice: "All expired passports" 

 

My interview was in West Palm Beach and it took about 6 months for them to schedule my interview. West Palm Beach has a lesser case load compared to Miami Dade and Browars county - I'd recommend going for an inforpass once you reach 5 months.

I got fees waived for I-360,485,765 .  I am on hard financially situations now , do I need to fill up new fee waiver form (I-912) with AP application? Where I need send these applications to ? Can I just leave it blank on the travel plans part since I don’t have details on travel plans yet ?

    I see some local Offcie for AOS processing time is shorter than others .my local office shows that family based AOS will take 10 months to 27 months on processing time . 

   I see some people has 5-6 months get there AOS interview scheduled since VAWA case was approved. That is very wonderful to hear . 

    I do have a plan to move in summer and wondering if it helps me to get AOS interview scheduled sooner if find a place where less cases are there . 

Does that possible and helpful if I move a place where has short AOS processing time ? Any place recommended if you know ? Please .

Thank you so much for sharing your experiences and support. Could anyone offer an advice?

 

1) My EAD/AP card is expiring in August, I want to make sure I don't leave a gap between them. Can I already file I-131 and I-765? It will be 180 days before the expiration date next week. And since I am divorced, should I add that in the application? Will they still approve my application even I am divorced since my I-485 is pending? 

2) I also noticed that the instructions for I-131 have changed, they state that AP is not for vacations. Should I cancel my vacation trip I had planned for April?

 

Sending patience for everyone, this definitely feels like a never ending process.

 

My timeline:

 

08/2014 - F1 student visa

03/2017 - Married USC (F1 expired in 07/2017)

07/2017 - Application for I-485, I-765, I-131

12/2017 - Approval  I-765, I-131

06/2018 - Divorce filed (approved 3 months later)

01/2019 - Renewal application for I-765, I-131

03/2019 - Filed I-1360 (lawyer)

04/2019 - I-485 interview scheduled, went with a lawyer and I-1360 receipt

05/2019 - Prima Facie received

08/2019 - Approved I-175, I-131

10/2019 & 12/2019 Traveled overseas (home country, no issues)

Congratulations to all who have being approved and for those waiting for approval you day is coming real soon....I am trying to figure out how to renew my C31 Ead which comes up for renewal June 2020 ...will I have to pay for the renewal?

Yes you need to either pay the fees for the 131 or send in a fee waiver I912 with it.  Do not leave blank parts- you can either put in an estimated travel date/plans or simply write unknown.  Also it is a bad idea to try to move where immigration offices have quicker interview slots opening. Mostly because processing and wait times are always changing. Local offices cover a pretty big radius as well. The best thing you can do is live your life and just let the immigration stuff process in the background.

You can file when its atleast 180 days prior to expiration. Do not mail it any sooner. Martial status does not impact it. Im not sure what part of the instructions you are referring to about AP not being for vacations? The form 131 is used by many people for various types of travel purposes and authorization. Assuming you are renewing a C09 EAD/AP combo card you are allowed to use it for vacations or non-emergency travel.

C31 EAD needs to have either the fees paid or a fee waiver form attached that gets approved. You can file it up to 180 days prior to expiration. After you file you will get a NOA which also serves as a 180 day extension for your old card.
