That's how I understood what the poster said but you know the reason I am confused because I got my EAD under c31 category after 5 months I filed for VAWA which I didn't expect because the usual I have read here is that you will only get EAD under c31 category after vawa approval. I am very thankful though :) I am still waiting for vawa approval, now on my 12th month.

I think you are confused. Most likely you have a c09 EAD. IF you have a c31 EAD then your VAWA would be approved. C31 is only issued for approved VAWA cases. Please check your EAD card. Here is a link to a page with a card pictured- https://www.uis.edu/internationalstudentservices/employment-authorization-document/ Under your name theres a line with your USCIS A # and then it says which category (c09 or c31) and then a card number. Does your card say C09 or C31?. If it says c09 then it was issued based on your previously submitted 485 packet with your spouse. The c09 card will be valid as long as your spouse does not withdraw the underlying 130 that was filed along with your 485.

When VAWA 360 is approved a c31 EAD is usually automatically issued (even for those that didnt ask for it).  You can use your c09 EAD as long as its valid though and can renew it if/when needed. Just be careful when renewing to use the correct category.

My case was under:

"card is being produced" 3 hours after interview to this:

I read someone asking about tax documents - I did not bring any since we use the form I-864w and officers aren't supposed to ask about your filing status or tax documents. But if you have them and makes you feel safer you can bring them

Congratulations 👍👍 please tell me how long did you wait from receiving C31 to interview.? What did you bring to the interview.?

Sorry dear..was driving. As VAWA petitioners, we are exempt from the i864 hence the waiver which is the i864w! If it's not clear let me know. But the important thing is we need to present it when we file or at the interview.👍

Very very clear my dear thx alot

Hi! Because of this I went back to my documents and now I am more confused because I kept copies on everything I sent.  With my i765 that I originally sent 1 year ago I put the category c31 and even the receipt notice they gave me before I got my combo card said "Class requested: C31"and I didn't notice until now that the combo card I received says "C09P".

I never filed an i130 with my abusive spouse ever I filed  vawa directly.

Also I just received recently a biometrics notice of appointment for my newly requested i765 because it is about to expire on May 2020 and the receipt notice with it says "class requested: c31"

Could this be a mistake by uscis on issuing me a C09P? Which I don't mind because I badly needed work and now am working.

Can you or anybody shed some light? And by the way what could C09P meant?

CO9 is the combo card. You should pay serious attention to your documents. Now the whole situation is clear. Your VAWA isn't approved yet. When it does you will get the C31 EAD. For now focus on work so anxiety doesn't get the best of you. This process takes time. Your day will come.👍

I received my work permit on Aug 12 2019 under c14 category.

Then i went to my interview on Feb 10th. Got approved after 3 hours.

I brought my updated medical, drivers license, passports with visa, birth certificate and form i864w.
Also certified arrest record and court disposition (I’ve been arrested before)

Additionally I brought my I-9, pay stubs and all the documents I had submitted before

Congratulations on your approval . Did you receive any RFE during your wait time .

1. You overstaying your visa in 2011 will not affect your green card application nor upcoming green card interview neither will you or your children getting benefits in food stamp and Medicaid affect you during your green card interview . Vawa applicants are exempt from public charge rule .

2. You do not need to pay for an advance parole document (form I-131) if you apply now . If you’re married or were married to one just attach your I-485 receipt when sending your application to Vermont . It worked for me that way anyway .

3. As long as you have your Advance parole document on you . You will be paroled into the United States of America on arrival from your travel destination . There have been testimonies of people who have traveled and came back successfully .

4 . You should get the card in about 7 business days or less . Congratulations.

Thank you very much for your replying ! I feel much better . Do you mean I am safe to re entry with AP even I was overstayed so many years right .

I have never received any RFE during the waiting time . And case status was only fees waived until it changed to “ new card being produced “ . I thought my case was forgotten by USCIS  officer .

Is there any chance if they send my case back to VSC again to review or revok it when AOS processing ?

I was in marriage when I was applied VAWA , I did got finalized divorce decrees after couple months but not send in to VSC yet . Does this will cause any problem?

Thank you very much again ! Wish all are well with you!

Yes . You can come back with a valid AP. I have a friend who overstayed for 5 years before filing AOS and then vawa recently. Just came back recently.
Your vawa approval won’t be revoked ,think positive in your life from now on . Your I-485 will be sent to Your local office now who’ll call you for a green card interview when a date and time is set for you . Take your finalized divorce decree with you to the interview and not forgetting the I-864W if you didn’t submit one with your I-485 . Once again, enjoy your approval .

Thanks for the information.? Did the officer ask you about the VAWA.? How long was it.? What kind of question did he or she ask.?

My officer was very serious. She did not ask about VAWA.

She asked all the addresses I’ve lived (all the ones listed on my I-485) and most recent one then asked about both my parents names after that she asked if I’ve ever been arrested, and all the yes/no questions in the I-485.

She also asked my marital status.

At the end she gave me a piece of paper saying my case needed further review; she said if she needed extra information they would notify me by mail otherwise she would try to make a decision the same – which she did, about 3 hours after my interview my case changed to: “New Card Being Produced”

Today my case was updated saying they approved my case & “New card was mailed”

Hello friends !! Congratulations to recent approvals - that's such great news for all of you!!

My C9 EAD was recently approved. I have a question. If my I-360 is approved when I apply for C9 EAD extension, would they issue both or just the C31?

I want to know if there can be gap with work authorization between the time when C9 is expiring and VAWA is approved.

Thanks!!
