I am confused when you said getting an c31 EAD (which is the i765 for employment) means vawa (which is i360) approval. How is that possible?

Yeah immigration has never been straightforward with their process haha. But I mean that while your VAWA is pending (if your spouse was USC) your EAD is C09 category. Category C31 is only given to applicants once they are approved. Looks like you may get your approval letter in a few weeks or sometimes even not get it at all, but if they sent you EAD with C31 category it means you're approved.

Usually when VSC approves your petition, they give you the C31 EAD. So even before you receive an approval notice, the C31 EAD is an indication that you're approved! This is the long and short of it!👍

The bold part. 

It's just the formal/official language. They approved the request period! Tell your friend to relax!😊👍

Hi, everyone 

    I want to thankful for all of you supporting me when I need help with . Since 19 months wait .I guess my VAWA case got approved because my 360 form updated as “We ordered your new card “ yesterday, i flied it in July 2018. I did not got any notice letter yet . 

    My questions are as below .

   1. how many chance I can get green card based on approved VAWA ? I have been overstayed since 2011 . One time speed way got ticket and paid fine in time . I am receiveing food stamps on my children ‘s name and Medicaid . If these count publicly charge and will effect my AOS interview later on ?

    2. I want to go back to my home country to visit my family , do I need to pay fees for apply AP ? Or if I can have fees waiver if qualified?  

   3. Can I re entry  US with AP ?(  if I can  eligible to apply one ) does it will be big problem that I already overstated since 2011 ? I heard it will meet 10 years ban . 

    4 how long need to wait to get 360 approval letter and c 31 EAD card ?   

     Thank you all of you ! 

     Wish all of you get approved soon . It is not easy to go through this long process.

Yes with Vermont. But before that I did my interview under my husband petition alone. But I told them I had filed with vawa he said ok he wud put my documents on hold.

That's how I understood what the poster said but you know the reason I am confused because I got my EAD under c31 category after 5 months I filed for VAWA which I didn't expect because the usual I have read here is that you will only get EAD under c31 category after vawa approval. I am very thankful though :) I am still waiting for vawa approval, now on my 12th month.

Mine is kinda different from what everybody is saying here. I filed under c31 category but my EAD came 5 months after I filed, and as of now I am still waiting for my vawa approval. It has been a year since I filed.

You shouldn't just sit still about it..contact your congressperson to know what the issue/delay is about. The content of the post is usually the norm and pattern we've seen and experienced. See what's going on with your case ASAP. Chances are that you're currently waiting for i485 interview, but you're supposed to get your approval letter.👍

Someone was asking me about form i944 and advising I take it with me when I have my interview..so I looked it up..it clearly states VAWA petitioners are exempt. 👇👇👇

 

 

I-944, Declaration of Self-Sufficiency

 

Use this form to demonstrate that you are not inadmissible based on the public charge ground (INA section 212(a)(4)). You must file this form if you are filing Form I-485, Application to Register Permanent Residence or Adjust Status, and you are subject to the public charge ground of inadmissibility. Please see the instructions for Form I-944 to see if you are subject to the public charge ground of inadmissibility. 

Certain classes of aliens (such as refugees, asylees, petitioners under the federal Violence Against Women Act, and certain T and U visa applicants) are exempt from the public charge ground of inadmissibility and therefore are not subject to the Inadmissibility on Public Charge Grounds final rule. For more information about the classes of aliens who are exempt from the final rule, please see the USCIS Policy Manual.

Oh wow really? I will get on this ASAP, I was just thinking it is a special case because also I forgot to mention when I received my prima facie first time and just recently the renewal it states "it is not expected that a final decision will be made in this case before the end of 180 days"

Do you know the current location of your i485? Did you get any update about a transfer?
