VAWA self-petitioner (Form I-360)

 

You may file I-485 under this category if you are the victim of battery or extreme cruelty by a U.S. citizen or lawful permanent resident who is your spouse (or former spouse) or parent, OR if you are the victim of battery or extreme cruelty by a U.S. citizen who is your son or daughter and is at least 21 years of age.

 

Special confidentiality protections (described at 8 U.S.C. section 1367) apply to you as the VAWA self-petitioner. 8 U.S.C. section 1367 provides two forms of critical protection for VAWA self-petitioners. The first form of protection is a prohibition on adverse determinations against the victim based on information provided solely by their abuser and other prohibited sources. The second form of protection is a prohibition on disclosure of any information about the victim to third parties, except in certain very limited circumstances.

 

If a visa is immediately available, applicants filing as VAWA self-petitioners do not have to wait until Form I-360 is approved to file Form I-485. If a visa is immediately available, you may file your Form I-485 together with your Form I-360, while your Form I-360 is pending, or after your Form I-360 is approved. Otherwise, you may file your Form I-485 only after your Form I-360 is approved and a visa is immediately available. See the When Should I File Form I-485 section above for more information.

 

NOTE: USCIS will not accept requests for Change of Address submitted online, mailed to USCIS Lockbox facilities, or by telephonic requests at the National Customer Service Center for adjustment of status applications filed by VAWA self-petitioners.

So I just got this @Stillwinning!!!😊 will I get a letter that also gives the interview date being that my I-1485 is already at the UScis  is office but my daughter I-485 is with Vermont.

Hi GiGi looks like your approval was updated online today but you already received the C31 weeks ago correct? If this is the case..you will have to wait for them to get you an interview slot..5-10 months from transfer date..then you will get the letter.

Congratulations 👍. Can I please ask when did you receive your C31.. and how many days between receiving C31 and this approval.?

Hi, paystubs and letter from employer is good too..don't you file taxes? You should have those documents..you could also order your transcripts from IRS! What's your situation?

Do I still have a transfer because I did my adjustment status with the regular immigration?

Okay I’ll probably order the transcript.. of course I filed taxes. It’s just I lost my copy from last year

By this I'm assuming you mean you filed with NBC? Really doesn't matter..when you file for VAWA..your file gets transferred to VSC..after you're approved, it gets transferred back to your local office for adjudication. So everything I said earlier applies!👍

Btw for people that received their c31 card and are waiting for approval letter. I had a pending request with a congressman (in my district they communicate with us and with USCIS via email) and the day after my status was updated to "card being produced" I got an email from congressman saying that USCIS informed her that my I360 is approved (even though I haven't received approval letter yet). So just like Sandra said - getting c31 EAD means VAWA approval.

guys i am asking this question for a friend of mine.

She had filed i-765 and i-131 based on marriage. it was pending since September last year. Last month she called to expedite her i-131 since her aunt passed away and she wanted to travel. after few days she received a letter for additional documents which she sent. Today she received a message that her expedite requested is approved. She would like to know if i-131 is approved or what does it mean?

Request for expedition is approved meaning her I-131 is approved she will received soon

thanks. i told her the same thing. but her concern is this

we approved your request for expedite processing on your Form I-131, Application for Travel Document, Receipt Number MSCxxxxxx. We are processing your case and will send you a notice of action with our final decision.
