Does a vawa applicant have to receive a prima facie letter? I had an RFE and did not get any prima facie. Now, I sent the RFE response and my status changed to "back in processing". Will I get my prima facie? Are there cases you don't receive it but get I-360 approved? Is it discretionary to give prima facies?

There have been people who never received it but were approved. If you intend to use the benefits it provides, you can contact your congressman to help. Sometimes it's just oversight on the part of the officers.👍

I am Sept 2017 filer. I-360 approved on Aug 8, 2019.

Received good moral character and birth certificate RFE (Good moral character was sent to a wrong address, so I missed the deadline) 

No divorce decree since I am still married to USC husband

My field office is West Pal Beach, FL

The USCIS shows the option I-360 on the drop box because the form can be used for widow, doctors,religious and juveniles, and they are not protected by privacy law and they can inquire.The Law didn't change for VAWA petitioners.USCIS is prohibited to answer any request online.

What are the proofs you use to declare abuse moreover has the immigration officer asked you about why you are still married and not divorce yet

No Idea... After myself,  I know 5 more people from another forum had make online e-request for their approval notice not received after getting EAD C31 and all their cases from last week has being assign to an officer and their status had change to approved and approval notice sent within 2 days after making the online request.... Maybe they are new officer with no knowledge of the privacy law.

That's on my I-360. I attached his arrest record, pictures of my face after he beat my face and hospital records for sexual and physical abuse also recordings of him saying he will kill me. 

 

Yes she did ask if I filed for divorce and why we are still married.

My answer:  I am afraid to divorce him - he threatened me and my family if I did so

I saved them in both flash drive and CD. 

 

I am not sure if they played/checked them though but I went ahead and sent them

How does it work with congressman - never did it and frankly dont feel comfortable as i am not a us citizen. Will congressman him or herself reach out to CIS or it will be their staff? What if I dont need the benefits - should I just disregard reaching out? Is it a red flag to not receive prima facie?

Please feel comfortable..they're very helpful. They've been helpful to a whole lot of people here myself included. You have nothing to worry about..reach out to them..they have your best interest at heart..give it a go.👍 on the other hand if you don't need the benefits, you can chose to ignore it. Prima facie doesn't mean your case will be approved..like I said before..there have been people who were approved without it. It's your call.
