Hi guys!

Congrats to everyone who get some great news!

I made a mistake and sent my (and my son’s) EAD renewal to Chicago instead of Vermont.

It was June 12  2019

But despite on this my son got his fingerprints interview on July 25.

He got his EAD week after that.

But I still waiting for mine.

I don’t know how to they processing it and why did they separated it if our application were in the same envelope.

Anyways.

Im working now with my notice of action which states that I can work 180 days more without my work authorization.

But my supervisor asked me if I can find out what is going on with my card.

So so my question is:

Can I call to USCIS if I filed under C09 category? But I have attached copy of I-360 NOA

Or they won’t give me any information through the phone?

Should I send a letter requesting information regarding my EAD

Thank you guys!

I know this question is obvious to many of you and it’s might be very irritating when someone asks the same question 1000 time.

I just don’t have a time to go back and read everything.

Try to do it at work sometimes but missing a lot.

You cannot USCIS because they are prohibited to give any information over the phone. Go to info pass or ask your  congressperson to inquire on your behalf.

@sandranjgood day to you and i hope your day is going on well.

Please can you confirm if the affidavit written by family should include information they have on physical and mental abuse during the marriage living with my partner in the US and when i fled?

Thank you for your response all the time.

Thank you again . @Stillwinning!!!😊

If they have knowledge about the abuse they can mention in the affidavit. They should inform when and how they learned about the abuse.

Hi all! I am so thankful that this thread exists, knowing that I am not alone in this terrible situation and that there are other people out there who understand what being abused means.

I am at early stages, haven't filed yet, because I am scared to file.. And honestly scared to take the step and leave. I know it sounds crazy, but my question is if anyone here (or if you know anyone) got approved for GC and VAWA after filing on grounds of emotional abuse only? With no Incidents of physical abuse? This is nuts even asking this, but I am afraid that since I am not being physically abused - I shouldn't even try filing :( I came on a K1 visa, been married for 6 months, just about to receive my first conditional GC (got EAD last week). My husband has been mentally abusing me since the day we got married (surprise, he was a charming person before that, I had no idea), besides the yelling/gaslighting and belittling me constantly he has tried to control my freedom: I wasn't allowed to have a phone number, I still don't have an US bank account cause he pressures me into putting the last of my saving in his account so he can control me completely, I am rarely allowed to meet up with friends, I always need to ask permission for every action, for every item I want to buy at the store (I pay with my own money, but it doesn't matter, I need to ask him first), he tells me what to wear... He also kicked me out from our apartment in November, but took me back after a week. I have a neighbour who witnessed that.

I talked to an attorney - she says that I need to call the police during one of the incidents, in order to build a strong case for VAWA.. But I am afraid. I am afraid that they will come and I don't have any signs of physical abuse and he will manipulate the situation against me and tell lies to police about me... I am terrified! I am also terrified if police comes, believes him and just leaves - I don't know what he might do I me then for calling the police. But I know I can't live like this much longer. Does anyone have any advice or been in similar situation? Please share 🙏❤️

70% of my VAWA cases  approved were victims of psychological abuse ,it means without  any physical abuse. You just need a psychological evaluation stating the abuse in detail, and if you have a diagnose of depression and/or PTSD you will be able prove abuse.

Thanks Sandraj. Pls may I know when it took this 'client' to receive his ead if you know pls?. My abusive usc wife withdrew i130 and I will be out of work by the end of June including losing my graduate studies. I feel so worried and it is my earnest prayer that I at least get my ead from i360 filing? Pls can you share with my the timeline for this client whose receipt took about 2months

My client received the EAD two weeks ago. You will get a work permit just if you refile the AOS.  It's not just filing the I-360.

Hey

can someone help me with example draft personal statement I want try to get it all together but I don’t know if I wrote it right

If you are talking about how to write an affidavit then just write your story of abuse like you are telling someone about what you experienced with your spouse when you were  dating, meeting her friends and family, about the proposal, marriage and abuse, at least 9 pages.

Thanks Sandra for your response. I included i765 and i485 together with i360 in my filing. I have read every bit on the postings in this forum and I have seen some get quick response (within 4 months to receive ead) whilst others a bit delayed. Just worried and stressed about how I am going to survive and what I might lose if the ead from this filing is delayed beyond june

Yes 6 months is considered normal, wait until complete 9 months to ask your congressperson to inquire on your behalf.

Legally speaking you can leave the U.S using the AP,  but it seems your I-485 is still pending adjudication and in this case if your wife withdraws forms I-130/I-864  your AOS will be denied. If you are not put in removal proceedings then you won't have a problem to reenter.

Thanks for your advice @sandranj

Yes you must submit form I-131   to Vermont.

Yes you can travel with AP, you will be fine. DO NOT TRAVEL ABROAD  IF YOU ARE  IN REMOVAL PROCEEDINGS.

Thank you for your response @sandranj

With approved I360 and pending I485 can I send a fee waiver to Vermont for my I131 request or do they not accept fee waiver after I360 approval? I saw someone saying we have to pay the fee but I don’t really have that money these days. 😔

Man do not pursue a relationship just because you love the person.  One-sided love is unhealthy and a waste of time. Clearly she doesn't love you otherwise she wouldn't be violent or psychologically abuse you.

Listen to Sandra!

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Because of VAWA they won't give you any info over the phone. So it's best to write them and also you can enquire through your congressperson. If anybody else has any other way...they can suggest as well!👍

You're always welcome.👍

Thank you very much for your respond.

Your greencard won't be denied because of that. So you can stop worrying about that! I know some folks who've got their GCs and still married.👍
