Hi everyone  I have a question

My friend had vawa case and she got green card 2017.
After , 2018 she married another country, her husband’s has tourists visa B1B2 category. They arrived in USA together after married and they live in NY. They sent all documents and paid 1225$ . He has his receipt number. He got fingerprint in September. Her question is
will they have interview? Because she is a green card holder she is not citizen yet, she also sent papers for citizen and she got fingerprint in November and it’s processing.

Any advice is important 🙏sorry for my English, I work hard for that 🥰

If he is here without status  then his AOS will be denied because his wife is just a green car holder. I know about  two cases that the spouses were arrested  at  the interview, they were illegal here. They were not my clients, but their spouses  contacted  me after they were arrested.

1-YES

2- a) YES, b) they just need to be legal here, c) Yes

3)Submit a police clearance from your home Country. Use affidavits of good moral character just if you prove that you can't get   a police clearance  from your home country.

4) Write again your affidavit stating the Courtship in detail. Get affidavits from your family mentioned you had a bonafide marriage(2 to 3 pages).Affidavits written in the U.S must be notarized, affidavits from your family living abroad don't need to be notarized.

Please read VAWA threads (10/17),  there are a lot of information how to to prove bonafide marriage.

Thank you @sandranj

@sandranj can u help with the 2nd question here?

2. Can H1b holder take on another job with C09 EAD but still maintain H1b status with primary job?

I  answered before about this, but please do not consider that information. Today spoke with my colleague, who is a business immigration attorney, and he said using the EAD will terminate  your H1B status.

Hi guys I hope everyone is having a wonderful day.

so remember last week I was panicking about the RFE update that I saw. Well today my lawyer contacted me and the RFE is for police clearance from my home country I am relief because I could have been proof of abuse or something like that. So now I’m trying to get everything in order to have my cousin get the clearance and send it to me. 🙌🏾 God has been good.

That's awesome ..

Local offices adjudicate the cases in the order they receive the cases at the local office.

So if my case was transferred to new USCIS local office because I moved then it has a new date, correct?

Guys,

I just checked my passport expires today. Can I bring an expired passport as a form of ID? or can my EAD count as governemn issued ID for the interview?

I will try to go to my consulate and get it renewed next week.

Thanks in advance.

If you are adjusting status from K-1, and your filed your I-485, if your spouse has not pulled the I-864, then there is a possibility that your GC interview will be scheduled and adjudicated.  If you ask for your GC to be placed on hold, pending I-360

THEN:

The clock to process your I-485 does not begin until your I-360 has been approved, afterward your I-485 will be sent to be processed at NVC and then to the local office to schedule an interview.  Your interview schedule will be based upon the local office's timeframe.

When you filed I-485 prior to I-360 is irrelevant.  You currently do not have a valid status for GC to be adjudicated.

This is so awesome! When did you send in your case? How long after you sent in your case did you receive your EAD

Hi everyone! I have recently sent in my application to Vermont for Vawa, adjustment of status, work authorization and travel docs, along with the waived fees. Uscis has sent me a receipt that they have received my application. I believe that I will need to wait for my prima facia. Can anyone tell me how long it will take to get my work authorization and what are the next steps at this point? I have an attorney on the case, but she doesn't seem too helpful as I have a lot of questions and she doesn't really answer them! I am staying positive and I love this community so I don't feel alone! Any information that you can give will be great! Thank you!

Hello.

I apologize for this, which I will write.
I am not a lawyer, but I study a lot and think a lot.
I know that you are very helping people here.
BUT
What you wrote is natural ... natural and real, that if a person works by invitation at work, then what does this have to do with another issue? Or one or the other, these are laws everywhere.
