2.residence requirements . proof i lived with the said partner . my name is not on mortgage or utility bills except for health insurance. 

     a.) can i submit medical bills and reciepts?

    b.) affidavit from friends. Must these friends be LPR OR USC?

     c.) Can i also submit fertility treatment contracts and medical notes which is in both names?

 

3. Good moral character

   a.) the RFE states i have met the requirement for the US but i have not met requirements of my  country. I have commence process of getting criminal record clearance . i also have all my letters of employment , appraisal, community work back home and promotion letters from all the places i  worked . will it be good to submit these?

    b.) affidavit from friends. Must these friends be LPR OR USC?

 

4. Good faith marriage.

a.)How do i go about this ?

b.)will the Affidavit from friends who knew us together be notarized ?

 

I know this is a long post but i am just devastated . I have been through a lot but i dont want to put a lot information here . i am not sure my lawyer has deep knowledge about Vawa cos for 1 he just said there is law that protects me and that was it. asked me to get the other documents.

2- a) YES, b) they just need to be legal here, c) Yes

3)Submit a police clearance from your home Country. Use affidavits of good moral character just if you prove that you can't get   a police clearance  from your home country.

4) Write again your affidavit stating the Courtship in detail. Get affidavits from your family mentioned you had a bonafide marriage(2 to 3 pages).Affidavits written in the U.S must be notarized,affidavits from your family living abroad don't need to be notarized.

Please read VAWA threads (10/17),  there are a lot of information how to to prove bonafide marriage.

I don't think I know how to make that cover letter that you suggest. Instead of making such a letter, do you believe I can take a new Form I-864w corrected on the day of the I-485 interview without any risk?

The Answer here is clearly 1.d as marked already..... 1c is not the answer , reasons is (1)Amerasian means: someone with American or Asian parent , 

(2) widow is for women clearly means ur husband spouse is dead  and widower mean your wife spouse is dead... so before anybody click 1c as ur answer make sure ur spouse is dead or u are a parent of a US citizen and u where abused... i360 form clearly states the difference..,, you will need to present a death certificate at ur interview..

(1.d) is the right answer 

Battered means injury by repeated blow or punishment 

(b) spouse means wife or husband of a US citizen in this case or child....  so there fore  if your spouse is alive 1.d is ur answer .... but if ur spouse is dead then 1.c is ur answer

I have been arrested on a domestic violence misdemeanor before, I do have the court disposition that the case was dropped but do you recommend I hire a lawyer to come with me to the interview? 

I suggest you hire an attorney specialized in VAWA to attend the interview with you.

Thank you. and do we still have that option that if you file for a new work permit in advance you have those 6 monts that you can still work after the exp date until you wait for the new card to arrive? 

You have to file form I-765 to renew you work permit. Legally speaking you should not work with your EAD expired.

So this means I can’t send an AP request to Vermont now? After receiving c31EAD are we supposed to send the AP request to local office instead of Vermont?

 

I have my AP valid until May but my dad is getting cancer treatment and I have to be ready for any circumstance. 
 

Another question...is it ok to leave US while having a pending AOS after receiving c31 EAD? 

Yes you must submit form I-131   to Vermont.

 

Yes you can travel with AP, you will be fine. DO NOT TRAVEL ABROAD  IF YOU ARE  IN REMOVAL PROCEEDINGS.

Hi guys I hope everyone is having a wonderful day.

 

so remember last week I was panicking about the RFE update that I saw. Well today my lawyer contacted me and the RFE is for police clearance from my home country I am relief because I could have been proof of abuse or something like that. So now I’m trying to get everything in order to have my cousin get the clearance and send it to me. 🙌🏾 God has been good.

Your children will not be approved  automatically when your I-360 is approved. Once your Green card is approved your  attorney needs to file form I-824 in order for your child to immigrate  to the U.S as your "derivative " under VAWA.
