Did your online status change when you received the interview notice? Mine hasn't - I just received it in the mail yesterday

USCIS has no business regarding your debit.

 

You should apply for medicaid if you have the prima facie, if you don't have health insurance.

Hey All,

 

Just wanted to update you on I-824.  I sent in the application, documents, and fee.  I received my NOA1 in December.  So here I am waiting again.  USCIS stated that it is up to 13.5 months for approval.  Was wanting them to come and permanently live here this summer, but they will visit until final approval.  

 

Good Luck and Congrats to everyone.  Keep your chin held up high and remember the Glory of God's Blessings.

The right answer is 1.d (battered spouse).You are not 1C because  are not a widow, you are not an Amerasian (born after 12/31/1950 and before 10/23/1982); and you are not a special immigrant either, special immigrant are religious workers, Physicians,Juvenile, Afghan and Iraqi workers.You are a battered spouse, even if you were not battered.

I filed my I-485 a few days before September 11, 2018, when the Regulations (RFE) entered into force, which indicates that USCIS has total discretion to deny cases (applications) without having to issue any RFE. As I understand that rule would only be applied to cases filed from that date (11/09/2018), which in theory means that my case should not be affected by having been filed before that date.

 

 

In Form I-864w, Part 2 (Reason for Exemption, I selected option 1.c ("I am filing for an immigrant visa or adjustment of status as a self-petitioning widow (er) using Form I-360, Petition for Amerasian, Widow (er), or Special Immigrant) instead of selecting option 1.d (I am filing for an immigrant visa or adjustment of status as a battered spouse or child using Form I-360).

 

 

Question:

1. Do you think that by having made the aforementioned error USCIS can proceed to deny my I-485 without first sending me any RFE about it or do you think that this error is not significant and that I can therefore wait to arrive at the interview to clarify it ?

P.S: I didn't request USCIS to hold I-485 till I-360 is processed, planning on doing so at the interview.

Local offices adjudicate the cases in the order they receive the cases at the local office.

Hello everyone i just received an RFE and I am devastated. I will like @sandranj, @Stillwinning!!!😊 and any other person who has received this RFE to please advice on how to go about it . 

 

My RFE States :

 

1. qualifying relationship prior marriage ,need to prove i did not know partner was married when i got married to him. i will never have married my partner if i knew . when i was searching the house i also found a sworn affidavit  stating my partner single and not married before moving overseas. this was done 3 years before we got married .can i submit this too?

 

2.residence requirements . proof i lived with the said partner . my name is not on mortgage or utility bills except for health insurance. 

     a.) can i submit medical bills and reciepts?

    b.) affidavit from friends. Must these friends be LPR OR USC?

     c.) Can i also submit fertility treatment contracts and medical notes which is in both names?

 

3. Good moral character

   a.) the RFE states i have met the requirement for the US but i have not met requirements of my  country. I have commence process of getting criminal record clearance . i also have all my letters of employment , appraisal, community work back home and promotion letters from all the places i  worked . will it be good to submit these?

    b.) affidavit from friends. Must these friends be LPR OR USC?

 

4. Good faith marriage.

a.)How do i go about this ?

b.)will the Affidavit from friends who knew us together be notarized ?

 

I know this is a long post but i am just devastated . I have been through a lot but i dont want to put a lot information here . i am not sure my lawyer has deep knowledge about Vawa cos for 1 he just said there is law that protects me and that was it. asked me to get the other documents.

They will not deny the I-485 because of your mistake.Just file a new I-864W and put in the cover letter that you made a clerical error and you are submitting a new I-864W.Submit a copy of your I-485 receipt.  You can submit a new 864W because everyone can correct a clerical error before adjudication of the case.
