I agree this community is such valuable help. For instance: Before joining here I had no idea I could renew for c09 ead if I had a pending AOS app pending through US citizen spouse & of course the attorney who filed for me did not know that 😅

My DL is expiring. My EAD is expiring in June. 

 

Also what do I put for my current immigration status? Vawa was approved couple of weeks ago but I'm also in proceedings too.

I know dear..it was the same description that influenced my choice of 1c as well...waiting for more inputs but for now I'm holding on to what Villanelle said as she's quite knowledgeable!👍 I'm concerned about ticking only the appropriate category!💁

Now I am worried because I do not know if the category under which I select my Forms (I-360, I-485, I-864W) is exempt from being considered a public charge. :( hopefully someone helps me clarify this:

The new public charge stuff DOES NOT apply to VAWA petitioners. 

 

VAWA petitioners do not submit an 864. They fill out the 864W which is "Request for Exemption for Intending Immigrant's Affidavit of Support".  On that form the correct reason under part 2 is 1d- I am filing for visa or adjustment as a battered spouse using form 360. Choice 1c specifically states you are using form 360 as a self petitioning WIDOWER where 1d is for battered spouse using form 360. 

 

Many forms are used for several different processes. So there are different choices on the form for different situations. Not only VAWA petitioners use the 864W and i360 but others use it as well. 

 

Form 360 is technically named i360- Petition for Amerasian, Widow(er) or special immigrant. As explained the 360 form is used by VAWA self petitioners but its also used by religious workers and special immigrants as well as widows of USCs as an underlying petition to adjust status. 

 

Everything you listed as your categories is correct. Your 797c for the 360 is under self petitioning spouse of abusive USC or LPR.  Your prima facie is for a form 360. Your 485 797c shows your 485 is based on vawa self petitioner (360). When they process your 485 based on 360 you do not need the 864 but instead need to provide the 864w. The 864W is a form exempting you from the affidavit of support. So again, there is no public charge determination as you are exempt from the 864.

Thats not an issue with USCIS but you do need to handle it. Most hospitals have what they call "charity care" programs where they can reduce or eliminate bills based on your financial situation. They are also often able to help you get medicaid (backdated to cover the bills) or as a last resort set you up with a payment plan. The best thing you can do is reach out to the billing dept at the hospital and explain you need help. It can be hard and stressful to deal with them but overall its better to deal with it asap then to ignore it.

"I am applying for an immigrant visa or adjustment of status as a self-applying widower using Form I-360, Petition for Amerasian, Widow (er), or Special Immigrant.
