AMEN!! I will update the status as soon as I find out. I have committed myself to help others in any way possible from my experience and my case hasn't been easy. Approvals and interviews are coming for all of us this year

I will keep 1.d for now as we all are battered spouses filing through form I-360 but will wait for Sandra's response and others

Looking at my VAWA approval notice right now it says CASE TYPE: Form I360 petition for Amerasian, Widow(er) or Special Immigrant.

Hey guys, I can't find this information anywhere.
So, my I-485 application was filed in October 2018... I read somewhere that interview for family based I-485 will happen during the next 2 years from the date you filed and if it does not happen then USCIS just mails you a GC.
So, is 2 years is a maximum waiting time to schedule an interview?
I am asking because I applied for VAWA in April 2019 and I am expecting decision on VAWA around November 2020 as per current timelines, which is 2 years and 1 months after I applied for I-485. So the question is will I-485 Interview be scheduled during 2 years after application date or that's not for sure?
P.S: I didn't request USCIS to hold I-485 till I-360 is processed, planning on doing so at the interview.

I hope I'm able to make some sense..but if you haven't attended your marriage based interview, you should ask for the i485 to be held when you eventually do. Also the case(i485) will be released again for adjudication only when your i360 has been approved. This much I know!👍

Battered Spouse, Children and Parents

As a battered spouse, child or parent, you may file an immigrant visa petition under the Immigration and Nationality Act (INA), as amended by the Violence Against Women Act (VAWA).

The VAWA provisions in the INA allow certain spouses, children, and parents of U.S. citizens and certain spouses and children of permanent residents (Green Card holders) to file a petition for themselves, without the abuser's knowledge. This allows victims to seek both safety and independence from their abuser, who is not notified about the filing.

Just out of curiosity do you have a link of where you read that about the two year interview or else they just mail the card with no interview? 

 

Anyway- Im not sure if such a policy exists as Ive never heard about it before but if it is true as Stillwinning explained the 'timer' on your 485 only starts when the underlying petition for it is approved. So your 360 has to be approved and then you can start counting 485 processing times. Some local offices have a wait of 1-2 years for interviews! Again you dont start counting until the 360 is approved and then it takes a few weeks for it to get transferred around where it will end up in the local office waiting for an interview slot.  I understand you previously filed the 485 but unfortunately the time it spends/spent pending does not count for anything as the spouse of a USC. If you are the spouse of an LPR you can use the priority date of the previously filed 485 though.

Hi @Stillwinning!!!😊 quick question. I'm re-applying for my EAD. Do I need to attach a copy of my driver's license or passport? My DL is expiring next month. I didn't know if I could send it or not.

Is it your DL or EAD that's expiring next month sir? You are supposed to renew at least 180days prior to expiration. The EAD that is. It doesn't hurt to attach all. It's all I.D. Also a couple of passport style photographs.👍

I can relate, that's the same issue am facing with my lawyer, he can't even advise me on nothing, he doesn't even know if my work permit has to expire or not. My case is the least of his problems and paying him a lot of Money. Please work as much as you can on your case.

agree with you.

Once me and my siblings had to renew our EAD. we went to the office filled out all the forms, signed, and paid. After few weeks my siblings got their receipts but i did not. I called few times she did not answer, then i went to her office. guess what happened? she forget to send me application. That was worse experience i had.
