Hi, I appreciate if anyone here can help me with the following:

A month and 28 days ago (58 days), USCIS ordered my I-360 EAD (C31). Which I received a few days later, but I still haven't received the approval letter from my Vawa I-360.

I ask:
What is the maximum time it usually takes USCIS to send the Vawa I-360 approval letter?

Thank you very much for your help!

Same here but i don't have 30 days yet, i will wait one more month if not received I will asked my lawyer to request last option my congressman. For some reason Vermont Service Center delays approval notices.

For Adjustment of status need to file form I-485 with all requirements and as a Widow of a Us Citizen form I-360 petition they only ask for this proof: A copy of your marriage certificate, Copies of evidence that her spouse was a U.S. citizen (passport, birth certificate, naturalization Certificate) and a copy of the death certificate of her U.S. citizen spouse.

file:///C:/Users/Jack/Desktop/Personal 2/i-360instr.pdf

Thank you so much. I read also that there is no need for joint bills and utilities but confused when her so called attorney asked her to go get the joint documents

USCIS I-360 instructions for a Widow of Us citizen does not ask for joint bill, or utilities proof, meaning they will process without it, just need to sent the documents mention on it.

Her attorney may want to reinforce her petition by sending joint documents proof, but since her marriage was short only  3 months, she can sent photos, and affidavits of friend and family, but is not a requirements for her category.

@Stillwinning!!!😊 I can’t remember if I had sent in an I-485 for my daughter I think I did. But I didn’t send one in for myself cause it was already and I got an interview with the uscis. But I got the vawa work permit and paper I got included my daughter on there I know I did a I-360 for her but the adjustment status I’m trying to remember if I did is there anyway to find out will they request one if I didn’t. My prima facie says expires in February but eligible for an extension do I need to write them to get another one? I didn’t know I could use it to go to school and I’m hoping I can get another one while I wait for my interview.

Yes you use your Prima Facie in that and and many more ways..check with @FeDaniela on that. I've never used mine. Also request for them to send you a renwal.👍

it is just i sent everything. I did everything my own. My personal affidavit could have been some stronger and according to the way Sandra suggests.

I just wrote 2 pages, did not include dates and events.

same happened with me and they issued me RFE. and then I submitted 16 pages personal affidavit.

Filed: Other Timeline

Hello community! Would someone please advise: where I-485 papers are processed for I-360 vawa cases? Are they being processed in Vermont or at a local office where the applicant resides? Also, will I-485 interview take place at a local office? I think my I-485 application was filed to Vermont along with I-360 paperwork.

As a VAWA petitioner, all applications are submitted to VSC. VSC in turn redirects as required. Your i485 is forwarded to your local office by Vermont. So yeah the timeline for your local office is what you should be looking at.👍

Thank you so much. Will vawa I-485 at local office fall under “Family-based adjustment applications”? What happens if I-360 is approved after I-485’s estimated processing date? Does estimated processing date  mean the interview date on the USCIS website?

Yes family based. After i360 approval, your i485 is forwarded to the local office where it joins a queue (that's when you start counting).  The estimated date is what it is- estimated! Reality is in the field offices where it all goes down. Sometimes it's fast other times it's slow. Patience is what we all need.👍
