Timeline

I had a new question I want to ask regarding VAWA

 

if VAWA is denied for the beneficiary and removal proceedings begins, Can beneficiary still AoS thru the original petitioner in the midst of the removal proceeding process and succeed with adjusting status?

Good morning. Is there a state where the wait time for interview is shorter???

Thank you so much @sandranj I really appreciate your response and all your help. I’ll start working on getting the police clearance from my home country and the declaration as well!

Notice to appear policy for I-360 and other humanitarian form started on November 19, 2018, it does not matter if your case was sent one day before or later, the NTAs base on denials will be implement even if the case was sent before, the main reason is the it was denied.  But USCIS will continue to prioritize cases of individuals with criminal records, fraud, or national security concerns and will continue to use their discretion in issuing NTAs on these case types.

USCIS can denial the case without issuing an RFE, if NTA base on that denial is issue and you no longer in a period of authorized stay, than you will have too, unless you find another type of immigration benefits relief and can be used.

Also, one question my EAD and AP will expire on May this year, should I start requesting renewal now so i will be on time? Waiting for Vawa approval is painful :(

I'm from June 2018, and I was just recently approved, I know two other Vawa applicant one from July 2018 that was also approved and another one from August 2018 just received RFE... So far it seems they are working on January 2018  to August 2018 but is unpredictable. Regarding your EAD renewal you should sent it ASAP, since is taking 5-8 months, as soon as you received your Renewal receipt you can show to your employer since is proof of your 180 days automatic extension.

You can applied for FAFSA with the prima facie since is a federal student aid,  since student loan have more requirements you will have to verify with the school.

In my honest opinion if the beneficiary does this will open door reasonable doubt it will seem like they are using AOS process to avoid immigration law. You can consult with an attorney to check options and if is possible.

https://egov.uscis.gov/processing-times/ check the processing time by state... they are some with less time than other but is not something you can predict, processing time sometimes are not 100% accurate.

Hi All,

 

These forums have been really helpful and have given me some hope in the middle of this nightmare. Thanks God I realized that there was a light at the end of this path after all the threats and abuse of my wife against me.

 

I got married on October 2017 and this is my time line so far:

 

03/08/2018 - I-130 received by uscis (PD)

08/06/2018 - I485, I131, I765 received by uscis

08/13/2018 - Fingerprint fee was received

09/05/2018 - Biometrics done

09/06/2018 - Fingerprint review was completed

At some point here the I-130 was approved.

01/23/2019 -  I765 - I131 Case approved

01/25/2019 - Card is being produced

01/27/2019 - Card was picked up by USPS

01/30/2019 - Card was delivered by USPS

08/08/2019 - I765 - I131 renewal received by uscis

08/09/2019 - Interview Was Scheduled

08/17/2019 - I765 Case Was Updated To Show Fingerprints Were Taken

09/19/2019 - Interview in Hialeah Office (Hard Interview)

11/09/2019 - Decided to not continue with the threats and marriage

11/15/2019 - I360 - I765 - I131 Received by uscis

11/21/2019 - Filled for the divorce (She doesn't want to divorce and she is delaying it until now).

11/27/2019 - I765 Case Was Updated To Show Fingerprints Were Taken

12/16/2019 - I360 Request for additional evidence was sent (Good moral Character)

12/31/2019 - Response To USCIS' Request For Evidence Was Received

 

It seems this will be a long way until i finish this process and I have some questions to you people because you are more experience adn time on it:

 

- I requested to move the priority date of my I130 to I360, this means they are going to process my I360 faster o the PD is only for the interview for the Green card?.

 

- There was a work permit and travel document in course since august 2019 because my current work permit finish on january 15th 2020 , if they approve it, can I use it or should I wait to get the work permit sent with the vawa?.

 

- Because this process takes a lot of time, can I use the travel document i filled before the vawa to go abroad while the case is still in progress or should I stay in the country until is approve?.

Hi. You just applied for vawa 2 months ago. It takes usually from 18 to 24 months to get vawa approved. AND now a days, usually 3 to 6 months to get EAD/AP

Thank you very much! What are options if I-360 is denied? Can I appeal for instance or resubmit?

Yes you can file a motion to reconsider, and sent more proof.
