I-129F is NOT only used for fiancé(e) visa.

No it's not fraud. Please know the process before you accuse people.

 

Filing the I-129F after you have filed a I-130 is called going the K3 route. It's on the form. It use to be about 10 years ago a viable way for married couples to get their spouse here because I-130's use to take 5 to 6 years to get approved.

 

What happened around February was filers noticed at Nebraska the processing waits were so long so people started filing I-129F. In the majority of the cases of folks waiting almost 5 months or more it forced the service to look at their I-130 and approve it and thus denying the I-129F. Which is fine because all the filers wanted to begin with was the iI-130 approved and to move on to next stage.

 

No fraud. It's on the application and it's a choice for I-130 filers to also file the I-129F.

Well they didn't so why are you bringing it up. She clearly has her timeline stating a I-130 was filed. Please read before accusing.

So currently 7-8 weeks. That’s around mid-January for you. Anything before that is fortunate. I think getting your hopes up for anything less than that is going to be a recipe for being miserable. 

Technically this week it should jump at the very least to October 21 as the CEAC website was down for uploading between the 11 and 20.

 

My first submission took 4 weeks to get reviewed. I am now almost at 3 weeks waiting on my 2nd submission to get looked at. 😞

How long did it take for your petition to be approved? Did you file I-130 and I-129f

They were at Texas Service Center; only place I129f has ever showed to have a connection with faster approval was Nebraska

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

Online filing did not exist until November so it's certain that she paper filed. I believe she had an LIN and not an IOE receipt as well. No, the petitioner does not need to be in the US to petition, but will need to move to the US either before or at the same time as the beneficiary, and will have to prove later in the process either already re-established US domicile or intent to re-establish US domicile by time of interview
