Timeline

Hello I am trying to get my wife an I'd from the dmv in North Carolina. When she went with my mom to do it they told here there wasn't enough time left in her i-94 so they wouldn't give it to her. But somoone told me that if she brings her I-797 for the adjustment of status with her I-94 even if it's expired she should be able to get an I'd from the dmv can anyone tell me if that's true or not

It is in some states,  check the DMV website for definitive answer

Typically all acceptable documents must be unexpired

Timeline

I got a Virginia driver's license recently valid for 1 year in my maiden name about a month after my i-94 expired and right after I got the AOS noa1 letters (we applied for AOS right at the end of the 90 days). But yeah, every state is different. Might as well try it though. Least they could say is no and to come back when her EAD is approved.

Our wedding day - Oct. 14, 2019 ❤️                                        Green card interview - September 10, 2020 = APPROVED! :D

NOA - July 14, 2022

Fingerprints Were Taken NOA - August 2, 2022

Depends.   Some are, some aren't.   Depends on your local field office and how backlogged they are.

NC will only issue you the DL when she gets the GC or the EAD after you file for AOS. Not before then.....

It may or may not depending on how long the interview takes to be granted.
