Hello!  Posting because I haven't been able to find clear info about this in my searches, but if it's been answered elsewhere please merge or direct accordingly!

 

I'm the beneficiary who came to the US on a K1 visa in September and got married in November. My husband and I found out we were pregnant on the morning of our wedding...! We had decided not to wait because we wanted a family asap and honestly thought it was going to take longer! I filed the AOS normally since nothing changes until the child is born (the pregnancy is still very early and we haven't even confirmed yet with the OBGYN that it is viable).

 

My question and curiosity - based on timelines the likelihood of giving birth before the interview is very high. Does paperwork need to be re-filed after the child is born to reflect the additional person in the household? Does USCIS need to be notified of the status change prior to the interview?

 

Thanks! Also just in case anyone asks - we're all good on the insurance front and my husband makes well above the required amount for a household of 2 or 3 plus I plan on working once the EAD comes in.

Congratulations.  My wife and I had a similar experience.  Pregnant after AOS submitted.  We did not file any additional paperwork.  When we arrived at the interview, we actually brought our son since we did not have a sitter.  They asked for additional proof, etc at that time and we gave them his records as proof of our relationship.  They did not even blink and eye or bring up changing our paperwork.

Congratulations! Both of you were pregnant at the same time? That’s unusual!

That is not necessary. Since today’s over the counter pregnancy tests are so accurate, you can be assured that you guys are indeed parents. Also, I personally found that the $1 pregnancy test from the One Dollar store is more accurate then the $20 one from CVS. Speaking as a father of two.

No and no. Just bring the birth certificate to the interview.

You can submit an updated i864 at the interview

The same thing happened to us as well. We showed up at the interview with a 1 month old and a updated I864. That is all we had to do at the interview

USCIS is not concerned with events, such as, impending birth of a child. They only care about it when it is a fait accompli, actual birth.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

Thanks for the responses! from the sounds of it, if the interview is after the baby is born we can just show up to the interview with the birth certificate and updated i864 in case they want either. Fingers crossed I don't go into labour AT the interview lol.
