After interview

My fiancé had her interview yesterday. It seems there may have been a communication issue because the interviewer asked her at one point if she could understand him. He sent her to a Filipino agent who asked all the questions again. The agent told her she would need to go back to the original interviewer. After so time waiting, the Filipino agent told her they would not be able to see her again And she was able to leave but if they needed any more information or documentation they would contact her. She left really sad and confused especially since her friend was also interviewed yesterday and she was approved. I’ve called in myself to get an update but they can only tell me our petition in in administrative processing and they will contact us if anything else is needed. I’m just wondering, is this normal? Is there something else we should do? Should I worry about this or relax since the kept her passport? Please help if anyone has had this experience.

thank you

Chris

I feel so sorry for you and that is the very reason I had planned to be at the interview with my fiance.  There is just no easy solution to this, I was criticized for buying a ticket to be there and then our interview was cancelled because of a problem with SLEC.  I really hope all works out for you, keeping the passport is in your favor and it appears that administrative processing in PH goes quickly.  Best of luck to you.

Did they keep her passport? Did they give her a white piece of paper usually called a 221(g)? Did they give her anything with instructions where to pick up her visa when issued? Did she asked if she was approved?

They did keep her passport but did not give her a 221g. They said if they needed anything else they would let her know and she was told she could leave. After 2 weeks she received her passport along with a letter saying

212 (a)(5)(A) The petition is being returned to the USCIS for additional processing. We have tried to be patient and wait but no one has told us why it has not been approved. I’ve spoken to the Embassy, just wait is all they say. I’ve called the USCIS and they say it’s still at the Embassy level and no information is available. CEAC says refused but USCIS and the Embassy say it’s in administrative processing and no other information is given. It’s very frustrating not being told anything. We worked very hard providing everything they asked for but I don’t know if something is missing or what else could be the problem. The money is not an issue, I’m divorced, she was never married, she has no children. I just can’t imagine what the hold up can be because no one will tell us anything other than just wait. Can someone please help us to understand?

@Hank_ will come by shortly and answer this as he is more up to date on USEM procedures.

That seems weird, don't know how that section relates to the K-1 visa.

From the USCIS website:  Labor Certification and Qualifications for Certain Immigrants – INA 212(a)(5)

https://www.uscis.gov/policy-manual/volume-7-part-l-chapter-3

Without knowing more details I can't even speculate what is going on?

Thank you. Yes I had seen the labor certification info and thought it must be a mistake. We are just waiting to hear from someone. Thanks again
