Back in February, before I even knew there was a visa called K-1, my fiancee and I tried to get her a tourist visa to come over then get married. (I know, pretty stupid!) So when it was all set and done, she was denied because she didnt have enough funds in her bank to prove that she woudnt over stay over in the U.S. (with me)....So, we learned about K1 and were very close to NOA2.

But incase that they ask her during the interview that why she wanted a tourist visa back in Feb and then they see that one month later I applied for the K1 Visa. Will these be a red flag? Can she just say she wanted it just to visit? Her reason for wanting it is to spend vacation time in Las Vegas. I don't think this would be a problem since it was never given to her and this is a totally different visa now. Any suggestion of what to say incase they see this?

02/09/09 AOS package send Express Mail

02/10/09 AOS package received and signed.

02/17/09 NOA reciepts

02/23/09 NOA about March 3, 2009 Biometrics

02/28/09 FRE!!!! :(

03/06/09 Biometrics completed

03/30/09 Responded to RFE next day air to Lee's Summit, MO.

04/25/09 AP and EAD card arrives

07/10/09 Interview letter arrives for 8/19/09

08/09/09 AP letter used to re-enter the U.S.

08/19/09 Interview completed. Results in two weeks. ( I think we got it)

08/24/09 Letter in the mail stating Interview Approved. Welcome to the United States!

Sort of in the same boat. My SO has 2 refusals on her record. one in 03 and 05. A tourist then a student. Tonight I posted a somewhat similiar ? in the embassy forum. No responses yet. It is likely they have records of prior visa applications, especially in the age of computers. Anyway, after NOA2 you will have to fill out DS-156 and on there your SO will have to declare prior Visa applications. My ? in the other forum was wether they brought these up at the interview. There must be members that have experience with this. Good Luck.

Did they bring it up at the interview? I told my SO that I didn't think it would be a big problem. I said they might mention it. If they do I told her to give a brief answer and act like its not a big deal. I told her it is better to be prepared with a response prior to the interview.

They did. The officer asked my fiancé “So you have been in the USA before?”

She answer “No I didn’t. I wanted to but you denied me a tourist visa”

Not the same situation, but I was denied a student visa a few years ago and I got my tourist visa on December without any problems. You didn't do anything wrong, she just didn't have a strong case to prove she would return to her country.

If you explain that she applied for the visa because she wanted to visit you, then that's a perfectly understandable situation. You'll be fineee :D Good Luck!!

As mentioned in another thread - tourist/student visas are decided on totally different assumptions than the K-1. A denial for one does NOT have a negative effect on the K-1. You should be fine.

Be prepared to discuss it if it comes up. They will know already, right, since, from what I recall, the various forms sent back with packet 3 (or the visa application docs you take to the interview) have space to write in what visas you may have applied for in the past. They'll know the history and will bring it up if needed. Just answer all questions truthfully. Applied because I wanted to visit. 'Nuff said.

The reason for the previous visa denial can be overcome for the K1 visa by having you, or someone else, sponsor her.

For what it's worth, it's possible that the previous visa application could have been approved by the use of a financial sponsor. Meeting the public charge requirement is the one thing that a sponsor can do to help out a B2 visa applicant, everything else - primarily demonstrating that they will leave the USA and return home - the visa applicant must do on their own.

And what if this "previous visa denial" theme comes up at the interwiew,and they asks :

Did you wanted to visit your SO?(back then fiancée)???(when you applied for a visitor visa?)

Did you met each other then already? Or something..

This is pretty much what I would recommend saying. She applied for a tourist visa to visit her boyfriend but was denied. Keep it simple and truthful. Nobody did anything wrong. Somehow, we made it past 1984 without a thought crimes law.

Did the same. In April Anna interviewed for a tourist visa and was denied. No questions we asked at the K1 interview. But the letter of intent is gave to her to take to the K1 inteview stated that I wanted her to visit me here and after we were denied we decieded to get married not to be apart.

Like I said they did not even question it.
