By your logic, B1 (tourist visa) applicants should have their application fee refunded if they don't get the visa because 'they should have caught this when we first applied.'  You're suggesting USCIS should catch when applicants are ineligible and save them the trouble of applying????? That in itself is an administrative process so it would still require a fee. 

I'll eat my hat if Melania gets you your application fee back!

This is when a Timeline would be so helpful. I do have a question. You said you filed 2 months too soon. But you know the filing eligibility window starts 90 days from the 3 year green card issue date.
So are you saying you filed 5 months too early then? Or did you even know about being able to file 90 days before 3 year anniversary of Legal Permanent Status? Or are you within that 90 days of filing.
If they haven't sent your package back then I would gather a guess that you filed on time. People have had packages sent back being 1 day early. Check your dates.

 

As for daughter you can file I-130 as a step=parent and no it's not 4 months expect 12 to 15 months at best. Pray for Potomac service center but you will probably get sent to the blackhole of Nebraska service center.

No, it’s not.  If you don’t understand, there are resources available (like this forum).

The cost of ignorance and no research is expensive.  Bet you don’t make it again.
