The issue now is showing he is free to marry when he has stated he is married.

I guess I'm struggling to figure out how we fix that part or i guess the better term is deal with that. 

Just trying to figure out next step once I have all the info. 

I asked him if he had a copy of the ds160 from then.

A large number of fake visa agents (in the country your fiance comes from) erroneously believe that being married increases the chances of getting a visit visa to the US as it shows ties to the home country. So....they encourage and convince visa applicants (that are not knowledgeable) to lie that they are married in the visa applications. A lot of the time, the forms are actually filled by the agents on behalf of the applicants. Of course, most of these visa applications are still not successful despite the lie.

 

This situation is quite rampant and that i guess this is exactly what happened to your fiance.

I think this happened but based on questions people asked me I'm trying to get more exact info. 

Just don't know what the next step is after.

I am assuming he did say he was married and gave details of his spouse, now if he said he was single then that is a totally different situation.

There is a great chance he did not fill the form and has no idea the specific information about the 'spouse' that was filled.

 

He probably does not even have a copy of the application and will need to ask the agent who won't have it since it's about 4 years old.

Well i asked because you have to take the ds160 to the interview ....right? So I'm hoping he has that copy. I asked if he still was in touch with the guy but he said no.

No.

 

You don't take the form to the interview, it's completed online with an option to print a personal copy just before submitting the completed form.

My statement is not absolute.....just giving my opinion based on my understanding of how the system works in that environment.

You talk it well brother,lot of these has happened to innocent, agent has mislead and lier on behalf of many applicants at past which the lier later affect those applicants in the future

You can login and see what was on the form right now you don;t need him. Login in at ceac.state.gov and go to the DS-16 and pull it up yourself and see what's there. My husbands is there since 2015.

I can think of two paths:

1. Forget about him and find a new love:

 

What is the probability the CO didn’t ask him if he was married or about his wife during the B2 visa interview based on the application? Very low. He must have answered yes to that. In that case he and the agent intentionally put his status as married. That means he not only lied to CO that time and this time, he lied to you as well. In that case, don’t get entangled with liars and just move on.

 

2. Marry and  cross the fingers


If he really didn’t know about the agent’s dirty work and is innocent and you two really love each other and want to be with each other no matter what, go and marry him and pursue the spousal visa.

 

If uscis doesn’t have the record of his previous so called marriage, it will get to the immigrant visa interview. During that time, when they ask again about the previous marriage, he can answer directly that he lied during B2 visa application, don’t try to blame agent but say he lied to try to get B2 visa. If they accept that lie, he will be found inadmissible and be barred. Then go with the waiver process and hopefully get the visa next time.

 

If uscis had the record of his so called marriage because of returned i129f, they may issue RFE for past marriage and the you are stuck as you can’t even ask for the waiver at that time.

 

Path 1 is the easy path in my opinion.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved
