That's what im hearing. I'm just praying that we receive grace to get things fixed. I am working on trying to see exactly what was submitted previously.

Thanks everyone who gave advice it was appreciated. I am digging deeper into this and hopefully I will be able to come back with some info since it seems most don't post after their denials.

My understanding is that he needs to submit the Marriage and Divorce documentation.

Exactly. The marriage issue needs to be resolved first. Any possible misrep bar would be secondary to that...plus it's easier to get an I-601 approved than proper documentation of a divorce that never occurred.

If somebody is otherwise eligible for an immigrant visa but inadmissible for a waivable reason, they would be provided the option to file the waiver at that point.

The previous marriage issue has to be addressed first. Only then would the inadmissibility due to misrepresentation become relevant. Currently, there is nothing to waive.

Forget it. That K1 is dead.

 

A large number of fake visa agents (in the country your fiance comes from) erroneously believe that being married increases the chances of getting a visit visa to the US as it shows ties to the home country. So....they encourage and convince visa applicants (that are not knowledgeable) to lie that they are married in the visa applications. A lot of the time, the forms are actually filled by the agents on behalf of the applicants. Of course, most of these visa applications are still not successful despite the lie.

 

This situation is quite rampant and that i guess this is exactly what happened to your fiance.
