Read this example DS-160 application very carefully. Then ask your beneficiary to come clean and share exactly what was put on that form so that you can know how bad it is.  
 

Right now you’re being BS’d and since if you check “married” you HAVE to provide a name and address for the spouse (which the IO also has in front of him) you’re the only one in the loop being left in the dark.  If you don’t name the spouse, you can’t ever submit the application or it’s incomplete and gets rejected.


Me?  I’d be unhappy if I invested all that effort into someone who left out that critical detail that yes married was checked but didn’t add that a “spouse” was also NAMED in that application.  I’d be more unhappy if I got lied to and made to look stupid over it.
 

You can’t miss that and you are supposed to print out that application to bring to the interview by the way.  You’re getting snookered.  Your beneficiary?  Checking married AND naming a fake spouse puts him in a very bad place.


They’re giving him a chance to fix it, they have to because if he can produce some document then he’s off the hook.   Once the admission is made that there is in fact no spouse the denial reason will switch to a much more serious one than a missing document.

 

No wonder Nigeria is such a high fraud country if the “agents” routinely lie on simple B visa applications.  I don’t think you can lie on that level though unless the applicant participated.

I also think this was no ordinary mistake because if you had someone fill the forms and they ticked married they would have had to enter your spouse's details... So whose details was entered?

I think you need to find that out.

Does he know the wife who the agent "put down"?  Did he have a serious girlfriend, a common law wife, etc. at the time and was he holding himself out as married?

 

I think the way these forms work is that if you check off that you have a spouse, the next questions then ask for information about the spouse.

 

So unless the agent made a typo and just checked the wrong box, it would say wife and then say who that wife is.

 

And I find it hard to believe that an agent would just fabricate a wife without the client knowing about it, and give personal details about this imaginary wife, and not tell the client, and then send the client in to an interview for a visa without knowing that he's supposed to claim that he has a wife.

I think you need to ask more questions here about what is going on because "My agent did that and I had no idea" is hard to believe here. It seems more likely that he was holding himself out as married and the agent did exactly as he said, or that he and the agent were both actively involved in attempted visa fraud.

I hope he can either give you an explanation if he was indeed married (which will give the chance to get divorce papers) or at least get you a copy of what was filed last time so you can check who is that “spouse” they wrote down... Good luck

We plan on discussing it today. Based on what has previously been said I need to ask some questions that I wasn't aware of. I will definitely be doing that.

Obviously none of us knows if this was a real spouse that had been forgotten about or just a lie in an attempt to get a tourist visa, the latter seems more common.

 

The K1 can be returned to die, what seems to happens with the CR1 is that a RFE is issued for the prior marriage and divorce documentation, so the CR1 is not returned it just sits there waiting for the documentation to be submitted, Presumably after a while they close the case for lack of response.

So we had a similar thing happen at our interview. The embassy told us that their records show that my fiancé was still living with her ex as a couple. We were lucky because he got married! Since he got married we obtained a copy of their marriage certificate to use as proof that their relationship was dissolved. We a also submitted lease, and bills that show that she doesn’t even live in the same city anymore. It’s been frustrating to say the least! So now we are just waiting for the approval. The agent said once we prove the relationship was over we would get approved! We sent everything in yesterday so fingers crossed 🤞🏾

That's good you were able to submit documents. Im sure your approval will be to you soon. Best of luck and success.

Yes. We actually got a copy of his marriage certificate! That proves the disillusion of their relationship.

He lied to Immigration Officials. This is a lifetime ban. Should have been explained to him at the end of the interview
