They said its still a chance the USCIS can re-approve and send it back to to the NVC and then the conaulate.

Now there is a ban so im not sure how things are now since we wanted to just go ahead with the CR1.

@TennilleO after reading your experience & story I could say you a QUEEN👑 inside out you a QUEEN100% honestly, YOU'VE done so well to stand by your partner during a tough time as such.. I wish & hope you both come out strong from this mess, ishallah! Mainwhile, I'm here shining my eyes at my level of ignorance during B1 visa application, is a whole lot of MESS for real. I can't even wish it for an enemy... Smhhhh**

Hello all! 

I'm back and have questions. We have discussed everything and we are doing the I130. My question is what documents do you think will be needed to help our case based on the previous denial? Is there anything I should be prepared for that may come up or happen because of the denial?

The answer hasn't changed since you asked in 2019 -- at some point, you will need to present a divorce decree or any other official termination document for the marriage that your beneficiary claimed to have when he previously applied for a tourist visa.  The findings from the denied K1 case will not be forgotten by US immigration agencies just because you are filing an I-130 petition this time.  Other than that, maybe your immigration lawyer has some idea.  If you don't have a lawyer yet, I strongly recommend hiring one.  Your case is way beyond the realm of DIY.  Good luck and I hope you update us on your case.

I think you should consult with an experienced lawyer. I don't think this is a simple DIY. The consular will still need that 'divorce decree' from beneficiary for previous marriage (that never existed).

Wanted to give an update. 

We got married didnthe i130 and was approved.  He is now in the US. Covid pushed the process back a little but it went smoothly. We just loaded a lot documentation and also a affidavit stating the mistake and him taking full ownership. 

 

Since people never update I thought I would.

Basically, they claimed to be married so they must now show that the marriage was dissolved. There is no way to "prove" that somebody is single and the best evidence available to the CO is the statement signed under penalty of perjury (the visa application) that they are married. Undoing that is not something where there is a clear path to resolve.

There was a case like a month or so ago where somebody in a common law marriage at the time was denied for the same reason. They are trying again with a document that they hope will show that the common law marriage was dissolved. No updates and it will likely take the better part of a year or so before they hear back.

 

Anyway..

What exactly happened in this case? They claimed to be married on a past visa application but was never married? Was it a customary marriage that was dissolved? What paperwork was presented to try to show it
