I've got in usa last summer with a j1 visa and I got married in september with a us citizen, I am applying for AOS. if anybody had to go thru anything like this, or can give me an advice about my case please.I understant that from j1 to AOS is one of the most long and confuzing journey. also I don't know if I should hire a lawyer for my case if it is going to be that hard. is there any reason that the immigration can denied my case?

6/26/2005 arrived to us with J1

9/09/2005 got married

05/03/2006 send I-485,I-765 and I-130 to Chicago

05/12/2006 received Rejection Notice on I-130

05/15/2006 received Rejection Notice on I-485 and I-765

05/20/2006 send papers again

05/22/2006 USCIS received the forms(1)

06/01/2006 NOA1 for all 3 of them(11)

06/05/2006 TOUCHED(15)

06/15/2006 letter with biometrics appointment(25)

06/17/2006 I-130 and I-765 TOUCHED(27)

06/20/2006 biometrics taken(30)

Now I dont know much about J1 visa but I thought that there was a 2 year residency requirement before you could change your status. If that is the case then you would have to maintain your J1 status for 2 years and then apply for you AOS. Anyone else have any thoughts????

11/09/09 Rec'd letter Bio Appointment

11/17/09 Bio Appointment 8am

11/20/09 Called FBI-Prints were sent back to USCIS same day.

12/03/09 Rec'd email from USCIS that the RFE was a mistake.

12/04/09 Rec'd email from USCIS saying that I have been transferred for an interview.

12/07/09 Rec'd letter for interview on 1/11/10 @11am in Fairfax, VA.

01/11/10 Interview completed. Passed test decision can't be made.

03/02/10 Contacted Senator's office...No reply yet!

03/04/10 Senator office called says can take up to 120 days.

04/12/10 Service request filed.

05/12/10 Contacted Senator's office again.

05/12/10 Told over the phone that I was approved. Believe it when I see it!

06/04/10 Senators office tells me the adjudicator who interviewed me thinks I have a criminal record. Send out all paper work showing no criminal record.

06/08/10 Leave for Canada

06/09/10 Get RCMP certificate showing no criminal record. Fax off to senators office.

06/23/10 Approved for Citizenship

06/24/10 USCIS contacts Senators office

06/28/10 Find out that I have been approved for citizenship and they are just waiting to schedule my oath.

07/12/10 Put in line for oath ceremony....wonder how long that will be!

08/18/10 Called USCIS confirmed they sent oath letter for 09/17/2010 at 9am.

09/17/10 Oath ceremony at 9am..... US Citizen!!!! Applied for passport.

I feel you

I was on a J1 visa from 2004 to 2006 and now I filed AOS as well

I don't think that it will be complicated, we did not get a lawyer because they are just rip offs.

we did everything our selfs and it is working fine.

Reasons for denying your case can be things like:

- You're not eligible to adjust status

- You do not have an adequate affidavit of support

- Certain crimes

- Drug use

- They don't believe you're really married

- You didn't file the correct forms the correct way

Whether to get a lawyer is a very individual decision and depends a lot on your own preferences and circumstances. It's akin to asking, "should I get a CPA to do my taxes?"

IMHO, if you want to do it yourself, you should evaluate the following:

1) Do I have the time and inclination to do a lot of reading and research on my own?

2) Am I good at reading and following instructions -- especially instructions that are written in a convoluted way?

3) Am I highly risk-averse? (If yes, you should get a lawyer for your own peace of mind.)

4) Is my case very complicated or do I have potential "red flag" areas? (If yes, recommend you consult a lawyer before filing.)

5) Can I afford the legal fees?

I think the most important thing a lawyer can provide is that they know this stuff and they'll fill out your forms correctly and include the appropriate documents, thereby avoiding an RFE. (An RFE is a Request For Evidence and it will slow your case down.) Another important benefit is that if anything were to go wrong, an attorney should be able to find out why your case is taking so long and work to get it back into processing.

Many people do file successfully on their own every year. This website and others like it are testament to that. Again, it's a personal decision and you have to weigh the above factors yourself.
