I brought my Thai spouse to the US on a non immigrant visa and applied for an adjustment of status. She had the biometrics done (photo, DNA) and had an intereview scheduled. It was all going very quickly. Suddenly I received a letter from USCIS cancelling the interview. They told me that they would be in contact with me. Included in the letter cancelling the interview was a form letter which read:

NOTICE TO APPLICANT: If you have ever been arrested or detained by any law enforcement officer for any reason you must bring the following to your adjustment of status interview.... The rest of the letter frovides additional information.

This make me question as to whether my spouse has a criminal record or has had some kind of contact with the police.

If anyone has had this kind of experience or can give me their thoughts on this it would be most appreciated...

First, USCIS has a habit lately of sending cancellation letters for AOS interviews and then when you don't show up, they say you abandoned your AOS.

I advise you to go to the interview anyway and comply with every letter of their request. Often somebody with the same name or common variant has a police problem. Time for a come to papa talk with your spouse.

It seems like a routine info page they include in all their mails, I wouldn't start questioning my spouse yet...It would be bad to have trust issues like that so early. Saying that, if there is something, its probably time for your spouse to come forward. Yea, Def go to the interview, if they say your interview is cancelled the worst is you wasted your time and some money, if not atleast your process will trek along. Good luck.

I'm a bit confused with this post. A DNA test is done at biometrics? I thought it was fingerprints. Also, why would they cancel the interiew and then tell him what to bring? Don't all embassies require police checks? Before we speculate could it be possible the wifes fingerprints are on file in her country for a job? This AOS is'nt going smoothly for me either. The RFE is for w-2,s and 1099,s but I'm self employed. I sent my income tax and also my property taxes and county appraisal which is 17x higher then thier requirement and still an RFE. Best thing would probably be to ask his wife if her fingerprints are on file and for what reason. These USCIS folks can be very upsetting for no reason.

It's wierd that they would cancel your interview, and then send you a letter requesting what to bring to your AOS interview. :huh: Anyways, the only thing I can say is that my interview notice came with a notice like that. I've no idea if it's a standard thing they send with interview notices or not. It was not necessary because I've absolutely no criminal record. Whatever it is, my advice is that you should wait to hear from USCIS first, before asking your spouse. You don't want to upset your spouse and cause problems, if it turns out to be nothing. I would still go to interview. Its ridiculous, they got already her police certificate in interview.

Before coming here, I took copy of my police certificate. Maybe she needs to get one from her country again, they are very good about loosing things too. It might be the case. And take birth certificate in both languages, maybe there is some translation problems with similar name who does have a criminal record.

They included a letter such as that in along with my interview letter. Are you sure it was not in the interview letter rather than the letter cancelling the appointment? Either way, it's a pretty normal letter. I would imagine that they send it out to all Adjustment applicants.

Go to the interview. As others have said, USCIS has a strange habit of sending cancellation notices and then denying people for not appearing at their cancelled interview.

The note to applicant says "IF YOU HAVE EVER BEEN". It's clearly not specific to your case. No reason to jump to conclusions or speculate.
