Hi all, 

 

I am midway through my green card application (US embassy in London). The forms have all been approved and I’m now due to book a medical and interview at the embassy. Unfortunately my employer (government) have advised they won’t let me continue with the Green Card application process whilst employed (no movement on this, I’ve tried). Obviously when I have the green card we’ll move to US (American Wife) but I can’t risk losing my job in the mean time. Does anyone have knowledge as to whether I could pause the application in anyway, delay for 6 months etc whilst I get a new job. Worst case if I cancelled the application and then re-applied when I had a new job would there be any reason why re-applying after previously cancelling would negatively impact chances of being approved.

Do you mean visa?   You can not apply for a green card from outside the USA.

 

As for the visa application at the embassy you can delay this for a time.

No need to tell them and if you are worried about working out your notice period you can then tell them and get a advantageous deal done.

You are not applying for a green card.  You are applying for an immigrant visa.  To get the visa, you will always have a few weeks from where you are now, until the visa is in hand.  There's no way to avoid that.  Proceed when ready, with that in mind.  Note that the visa expires six months after the medical is completed.  Use it before it expires, and a green card will come in the mail to the US address you gave.

I'm not clear on why this is a problem.  Employers, even foreign governments, have nothing to do with a US immigration visa application.  The petitioner submits the I-130, and after approval, you apply for the visa and go for your interview in London.  If approved, you'll have six months from the medical exam to actually move to the US and enter on the spousal visa.  You decide when you tell your employer that you are leaving, i.e., give a few weeks notice.  All applicants for a US immigrant visa are advised never to quit a job, sell assets, or purchase plane tickets until you actually have the visa in your passport.  So the only time you need to tell your employer anything is when you tell them you are leaving your job after you have the visa.  Seems like you jumped the gun here by telling them you were applying or assuming that you will be leaving when you do not yet have the visa.  What if you are denied or there is a delay?  Despite this, they cannot do anything about your visa process to hold it up.
