Absolutely agree... his post history is visa shopping

B2 adjustments

J1 adjustment

Asylum Seeking Questions

Now AOS

I have a recommendation for OP.. send wife home, file I130 for CR1 and get in line like the rest of us! People trying to abuse the system are the ones making it a nightmare for those trying to do the right thing!

And jeopardizing future non immigrant visa applicants ... potentially including your own family members should they want to visit

I did not file i130. someone told me that I-485 is to adjust the status of spouse of Green Card without exit the US. so i was wondering that if i can file the I-485 to keep my spouse here in US.

Thanks

My understanding of the rules is that a PR can file adjustment of status for a spouse in the US after the I-130 is approved and if their visa category priority date is current.

Provided they retain legal status within the US during that time... her tourist visa expires in a couple of weeks.. she’ll be out of status and therefore not eligible..

as mentioned before, the op is looking for all possible ways to avoid following the legitimate entry route and has posts demonstating prior intent to adjust via b2, jp1 and or asylum

AOS Journey

  • I-485 etc filed 23 April 2020
  • NOA1 I-485 June 3 2020

  • EAD approved 12 March 2021
  • Interview Completed 24 March 2021

I know what he’s doing LOL

Just handing him that sick feeling of “geeze if I had filed that petition months ago instead of plotting how to game the system my wife might be in the position to adjust status”

No matter what, she isnt getting anything until he gets that I-130 filed and approved and she has to leave the US before her I-94 expires or she isn’t getting anything

Hello

I heard that Spouses and minor children of Lawful Permanent Residents can file for I-485 Adjustment of Status starting July 1, 2019.

Generally, the Adjustment of Status is the process by which an eligible foreign national already in the United States can apply for permanent residence without having to return to their home country to obtain a visa through consular processing. Adjustment of status refers to the change of the foreign national’s legal status from a non-immigrant (temporary) category to an immigrant (permanent) category.

Please if anyone can let me know if this is true information.

Thanks

The visa shopping and attempts to game the system from various perspectives that you are obviously doing is part of the reason why people from Pakistan and other MENA/S. Asian countries have such barriers to both immigrant and non-immigrant US visas.  You're doing a disservice to your fellow citizens.

Maybe consider moving back to Pakistan if you cannot comply with the legal avenues for an immigrant visa?
