My wife don't have birth certificate, so when i was applying for her I-130, we got her birth registered and she have the birth certificate now.

till waiting for I-130 result, but i read somewhere that birth has to be resister at the time of birth, and recently registered birth certificate can't be use for the AOS

What should we do? Any other document or affidavit needed, or recently registered birth certificate is acceptable?

This is for AOS in India.

So is your wife here in the USA or India? Because you can not do AOS while abroad. 

 

As long as the birth certificate is registered then there won't be an issue. But don't be surprised if it is not asked about

I think that the OP means Affidavit of Support. I agree, as long as it's a valid certified birth certificate it should be fine to use

Our CR1 Journey:

 

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

She is India and we will do counselor processing.

No, I mean affidavit from her parents, as proof of birth.

Like when my friend’s company applied for his GC he had to give two affidavit from parents and one secondary evidence because his birth certificate was never made (very common to not have birth registered in those days in Indian rural area). He had option to register at that time but was told that USCIS don’t accept  Birth certificate if it is not created with in certain timeframe of birth.

USCIS or Department of State? You are no longer dealing with USCIS, now it's NVC/Department of State. Go by the Department of State criteria, not USCIS

Really good point.

Yes, he dealt with USCIS.

But we will do CP so it will be NVC. So NVC/Department of state accept birth certificate created late?
