Soo... just entered the states to visit hubby for the holidays. thought I’d let you all know of any issues while visiting on ESTA with pending CR1 at NVC Stage.

Landed at LAX, just 3 questions:

- how long is your visit...? 1 month

- business or pleasure? Pleasure

- who are you visiting? Husband

Stamped my passport and said have a lovely day..

nice! Im at the NVC stage and I visit my husband every weekend as he’s only a 2 hour drive away. No real issues so far. They like the fact that I stay 3 nights in the USA and 4 nights in Canada. Border agent told me to “keep doing what I’m doin”

as long as you can prove that you’re going to leave the USA they usually have no issue with you coming over with a pending immigration case. 👍🏽

Yes, there are no rules for these itws at airports. Most of the time they ask 2 or 3 questions and let you go. If they ask further it is really to be sure you are willing to leave at the end of your stay.

They do random checkings too. In that case, you go secondary. You freak out while you wait (sometimes a long time) and then they ask you the same questions again and they let you go.

One trip it happened to me. I was so scared. There was this lady shouting at us because our bags had to be away from the main alley. She was shooting everytime new people were arriving. Very stressful. A lot of green cards holders were there and did not understand what was happening. So you see even when you have the green card, you can be put secondary. But in the end, unless they feel you are going to follow the rules, they let you go.

Have a good Sunday :)

I did this for a year and a half (except every other weekend rather than every weekend so 10 days in Canada for every 5 in the US) and they were always happy that I was doing things the correct way until one day they weren't and I was told that I had been flagged for frequent travel and as a result I would almost certainly be denied entry if I attempted to cross again before I got my green card. I was still let through that time and as a result decided I would stay for 6 months (or until we get our IL, whichever is sooner) so I can't comment on if that was an empty threat or not, but they had been expecting me so I'm not convinced that it was just a power trip.

Anyway, it looks like we cross in a similar area, so I just wanted to give you a heads up so if it happens to you (and I really hope it does not) you're not as caught off guard as I was :)

Good to know! Thank you! I always keep my employment letter, pay stubs, and the form I-130 every time I cross. My lawyer told me to keep all those docs with me so it shows them that I’m doing it the “correct & legal way”. Cant wait till this is all over and done with 😅  Anyways have a good Sunday.

Does Employment letter have to be hand signed? Hy HR department gave an electronically signed copy, I hope that's good enough for NVC?

Ours was same, I submitted it anyway, no issues yet
