I beleive you meant to ask when will you receive your EAD once submitted with the AOS package which is done after marriage. The state of Virginia has nothing to do with a work authorization. The answer is that it take 2-3 months.

 

Application for Employment Authorization Document (EAD): An EAD permits the foreign spouse to work in the United States. As a fiance you can apply for the EAD right after entering marriage. Likewise, you can apply for a Social Security number without having to wait for the EAD or AOS.

I have heard it discussed here on VJ before but I don't their results. You may want to search for that here on VJ. You can also request an expedite and that has worked for some but the circumstances have to be such that you are financially in need.

We applied for EAD when we applied for AOS. Im in Virginia. Its working out at least 6 months wait according to estimates. We applied in July...still waiting.

you can apply for an expedited work permit with a job offer in hand

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

6 months seems a good number, some are quicker some longer.

It is possible .. BUT ... always a butt ;)    But if you file the I-765 on its own it will be tied to the I-94 which has a shelf life of 90 days, AND you will pay a fee for this.  Basically you will file and kiss your $$$ good-bye as the 90 days would expire before the EAD was issued.

 

File with the I-485, it is free to file at that time, it will be valid for one year (renewal even).   Expect it to be more like 4-6 months as of late to receive the EAD card.

If she could get an offer for the company but based in the US would we be able to expedite? you need a written job offer from a company in the US where she would be working (the expedite process from start to EAD in hand takes right about a month). My husband was a union member in canada and transferred here, and the union helped us with the job offer.  You do have to provide a reason, and in our case we used financial based on my husbands personal expenses remaining in canada, and not family/household expenses. Like you, we did not need it for us based on my income but certainly the extra money was nice. However, I refuse to pay his ex wifes alimony ;)

Why would you?  It is free when filed with the I-485.

So could I use something about her parents being elderly/sick with a job offer in hand?
