K-2 stepson needs work authorization documents

When we filed for ROC in September of 2018, my wife got the extension letter, but her son did not (he's now 21). He did make an infopass appointment and got a stamp in his passport, but this is expiring in January, and his employer needs proof of employability beyond that.

 

He's tried to book an appointment, but the phone representatives tell him he should just use his letter. However, he never actually got one, it's in his mother's name. Still, they refuse to make an appointment to update his passport stamp.

 

Any suggestions on how to proceed? I see some cases being approved, but ours shows no sign of life.

Agree. It is USCIS's lackluster and pitiful rate of ROC adjudications that has resulted in their backlog and your problem. You and your family are just trying to get on with life. Suggest that you do as Georgia 16 suggests and "nudge" USCIS to do the correct thing and do it soon...., adjudicate your ROC petitions, and short of that renew the I-551 stamp in the passport. If they try to give you the hogwash notion that you should have filed a Form I-90 GC renewal, push back and tell them that they should have had your ROC petitions approved in a reasonable length of time.

 

Another option is contact Senator Murray's office (via email) and get them involved in getting your ROC petitions approved. You have patiently waited long enough,
