Will I get f1 visa? Plz help

Hi All,

 

iM KODI,  currently trying to apply f1 visa. Ihave serious problem. My own borther went to usa as f1 couple of years ago and married usa citizen then applied I130. Unfortunatlely she withdrew case in interview. His applation denied.

Later He applied for I360 and its pending  from 2 years already. 

 

He applied for my b1/b2 for his grad and I got visa and visited usa already for 1 month. 

My questions here is 

 

1. Can I go for  f1 visa in my country ? As my brother file is bad Will I get visa ? I also heard as I have b1/b2 visa and I did visted one chances of getting visa are very low

2. GO to visting visa to usa and locally apply for b1/b2 --converstion--> f1 visa?

 

 

Please suggest me.

Apply for F1... 

 

keep B1/2 visa for visiting while F1 is processing.. it will not be converted to F1.. they are two totally different visa types.

 

you CANNOT go visiting USA on B1/2 and then apply locally for F1, that is fraud... you are not permitted to visit with intention of transferring to immigration visa.

NO you cannot.. that is IMMIGRATION FRAUD.

 

you are not permitted to visit USA using a visitor visa with intention to adjust to an immigration visa

I wanted to be the safer side. Lets say I go for f1 visa in my country and I get rejected due to my bro profile and Then I come to usa by vistor visa and then convert and apply the changes of inland visa conversion is very hard as I have rejected already in my country. 

 

I want to be clean and get thing done right

Dude:  if you are hoping to pursue higher education in the US, you will need to work on your English writing, spelling and grammar skills, or at least familiarize yourself with spellcheck.  Admission to colleges and universities is competitive.

I’m not sure your understanding me.. 

 

yes you can apply for F1.. it might get approved, might not, it depends on your application.. 

 

either way, it’s still remains fact.. 

 

If the F1 is denied... it as AGAINTS the LAW for you to then ENTER the USA using a VISITOR VISA with INTENTION to CONVERT.. its Called Immigration Fraud!

 

it doesn’t matter how many times you ask the question or how you ask it... it’s not permitted...

 

the link is refering to AOS process... it doesn’t apply to you because you are not in the USA and are you’re not permitted to enter on visitor visa with intention of doing anything other than going home to your own country at the end of your visit.. You have already clearly demonstrated your desire is to adjust once there... therefore you are committing fraud if you do this...

I think there is a misunderstanding here, @Duke & Marie, OP seems to be talking about an F1 student visa, not an F1 immigrant visa.

 

OP, it is very risky to come on a B visa and try change of status to F1 because of timing issues related to the strict validity of F1 combined with long and unpredictable wait times for change of status applications. Moreover, there is no reason to assume that you would be approved from within the country if you would not be approved from outside. You have to truthfully answer all the same questions on the same form. Your best option is to apply from within your home country. No one here can say if your brother’s antics will affect your chances of success. If you plan to do the same as him, then you will be denied either from the US or your home country. If it is a genuine application and you can demonstrate what you need to, you should have a good chance of getting a visa.

Harsh, but true....mostly. There are colleges more interested in fee income than their students, hopefully OP would not end up at one of those though.

The first issue is the timing. None of that really matter though because he is clearly trying to circumvent the process so it will be denied. If he just happened to be in the US on a B and suddenly decided to start school here- again with proper timing it can be done. However he has very clearly stated he intends to use the B to enter to then apply for the F because he feels his odds are better for approval in the US vs his home country and that is definitely not allowed.

What is your ultimate goal?? To study in the US? Then as long as you meet the qualifications and have the money apply for an F1 from your home country.

To visit the US?? Then use your B visa as it was issued... for TEMPORARY visits. 
To move to the US?? Then you need to find a valid route and realize it will take time. It doesn’t sound like you currently have a US citizen immediate family member/spouse etc.
