Hi all! I am just new here and really have enjoyed the community. Ok, maybe I messed up by not hiring an immigration pro from the start, but I am getting your advice.

 

My wife, Nelia, is from Metro Manila and we have been married for 10 years. I worked for 5 years (and she lived with me at the time as my wife) in a small city in rural PRC (People's Republic of China) where I worked  as a consultant for an international firm. We had to leave after her grandmother died in Manila and her family fell apart.

We are submitting documents at this time to the National Visa Center, and from what I can garner her interview will be before May, at least from what I can see. She already has her NBI and her Barangay Clearance, no criminal problems at all.  The only issue is that I have worked my best to get her a Police Paper of no record from our area in China, and I just got in hand a few days ago her police clearance from China. However, the Chinese authorities for one reason or another will not issue a notary seal on it. I have done everything they asked and they still refuse to do so. If anyone is familiar with China, they seem to have their own peculiar rules from town to town. 

So, in desperation I hired a well reviewed Chinese/American attorney who handles this type of thing. He was able to get a police paper but with no notary seal. i have read the State Department website concerning this.

 

So, (sorry for the long post) when I submit my papers for Nelia in a couple of weeks to the NVC and to her interview in Manila at the US Embassy will they generally accept, without any hassle, a detailed letter from my attorney explaining why the Chinese notary refused to seal it along with the non notarized police check from PRC?

 

Nelia has been very concerned that she will be denied a visa just on this, even though I try to reassure her. She has been crying a lot and very emotional about this, which I hope is not a big issue Can anyone give insight or odds of this being a real block to her IR Spousal Visa?

They will require police certificates and here is the information you need.  This is not a local certificate.  It is a national police certificate.  Acceptable items (if available) are listed here... scroll down to police and court records.  BTW, there is absolutely no need to hire anyone else to do this process.  There is a lot of help and many of those agencies are nothing more than money hungry scavengers taking advantage of people who are intimidated by this process.  It truly is much easier than it feels.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

Yes, I have read this page. Again, I have a partial clearance from China. We were there for 3 years but they only gave the last year we were there.

 

They refuse to notarize it.

 

So, I have a clearance for 1 year, but the Chinese refuse to notarize it.

 

And China does not have national certificates, they are issued in the city you resided in. Hence, no standard rules.

No.  She needed Ireland and South Korea.

Ah ... I seemed to remember she did need a police clearance ...   in Rose's case .. or TWO  ;)

Doing great. All settled. Rose has her drivers license and all three are working at Walmart. Their first Black Friday and Christmas experience in American Retail!!!  Lol. They still get excited with each paycheck. They could not do that in the Philippines. My step daughter bought herself a new iPhone 11 Max Pro!   She was so proud.  They are still homesick but they are doing great.

Homesick will settle down but it won't really go away, there will always be moments.  Asawa ko has been here pushing on 8 years and there are still times .. like now as Christmas approaches.

Yes. Christmas here is very different than Christmas there. It will be tough on them this year as it is the first one away from family.
