Hello everyone,

I am self employed in the process of filling out I- 864 for my wife and was wondering if someone could chime in with some helpful advice.

1- which I-864 should I use . ( I-864 or I- 864 EZ)

2-  My income for 2018 is substantially higher than 2017,2016 ( almost nothing due to expenses and deductions) do I still need to report the income for 2017,2016 on 25a-c or just check I have filed taxes for the last 3 years and report 2018 only?

3-  I am aware that I can  send 2018 return transcript only, but will reported my 2017, 2016 income would that make a problem, raise a red flag, and will need a co- sponsor ?

4- will 2019 Taxes will be required if interview scheduled like mid April?

your assistance and input are greatly appreciated !!

You’ll need to report the three prior years in the form, but are only required to provide evidence of 2018 when submitting.. 16/17 evidence is optional..

with ref to the 2forms.. the EZ one is for sole sponsors petitioning for a sole beneficiary.. if there is one or more sponsors or beneficiaries then use the other form.

2019taxes would  only be relevant at the interview if you submit the AOS after filing 2019 tax return and noting it on the AOS..

You need to report prior years income on the form, no red flags, we put 0 and recent year was the bare minimum, nobody said anything and no co sponsor was required.

They might want to see 2019 taxes if the interview will be after April 15th 2020.

Self employed cannot use the EZ version under any circumstances.  I-864 it is.  Become an A-Student of the I-864 instructions.

I was wondering if you could elaborate a little bit ? Did the officer question your beneficiary about that zero income or issued A.P.?

Would that zero to minus income for last two years could potentially hurt my beneficiary chances even if my 2018 income meets the %125 requirements?
