Just before the holiday we received a RFE for my husbands AOS application. It's an easy fix as they are just asking for a certified copy of his birth certificate (my mistake, I sent a photocopied version originally). We have his original Canadian birth certificate and know how to obtain a certified copy from BC, but the website to order the copy on states it could take up to 60 days and the RFE states the info must be received within 87 days of the RFE notice.

 

We have basically submitted to the fact that we will just have to mail his original birth certificate and then order the certified copy to keep for his records since it's unlikely for us to get his original copy back, but it still makes me uneasy to send his only original copy. Am I just overthinking it?

As long as you can easily get another certified copy, relatively easily I would not worry too much about it.  Just a point of fact, no one possesses their original birth certificate, as that is kept by the government record holder, what folks get is a certified copy of the original, so the one you order will essentially be the same as the one he currently has.  What I find interesting is that USCIS is requesting a certified copy and not accepting a simple photocopy.

Send your copy. You possess a certified copy, not the original. At the same time, file for another certified copy.

I think its a bit strange also, as I sent photo copies of both mine and his. No mention on needing a certified copy of mine, only his.

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....
