Can someone please help me?

 

I just found out my fiancé has never filed taxes. He was unemployed until April 2018 and didn't file for that year because he would get no money back and didn't owe the IRS anything. We have the W2 as evidence but obviously we can't get the tax transcript. I also know that there's a step in the AoS process that asks you if you've filed taxes for the previous 3 years but he hasn't. Are we just permanently screwed? Is this considered a crime? I'm so sorry, I just don't know anything about this.

This is problematic on two fronts. First, you must file taxes whether you deemed you don't owe anything or if you do. The IRS determines that not him! This serious. The other is that the CO at the interview will use a IRS Tax Transcript to determine whether he is capable in supporting you. He needs to sit down at the computer TODAY and file is 2018 taxes. He goes to TurboTax and he can do it for free. He electronically sends it as a choice at TurboTax and in 2-3 weeks he can get a transcript. Simple solution he just has to get off his butt and do it.

We talked to his parents yesterday and the reason he never filed taxes is because he didn't make enough to be required to do so (he made way under $12,200) and we have evidence of this so I think we're okay? Of course we still have our joint sponsor who filled out the I-134 and makes more than enough money.

Let's be sure. Have him use this tool from the IRS website which will be the official requirement and not from us assuming.

We actually did this yesterday and we're 100% sure he was not required to file taxes. Should I have him write a letter stating that he was not required to file for the K1 interview or is that only necessary for filing the AoS since I'll be attending the interview and actually be talking to a person?

Anytime you have documentation to backup your position on a topic the better you are prepared.

I mean, we have his W2 from 2018 and 2019 and a document form his job showing how much he made last year. From what I've read on the forums not having tax returns isn't a big deal as long as you have a co-sponsor and made sure you actually weren't required to file. It even shows his yearly income in the I-134. I was just wondering if he'd have to write a letter for the interview and if so, what that would have to include.

Go with what you think will work for you. I've given you some suggestions but you return with another set of "what we want to do" scenarios. I would do it differently but of course this is not my case so I will let you sort through what you think will work best for you.

I'm sorry if I'm coming off as rude 😔 I'm just so over-stressed and I read so many different things online from people saying that if filing wasn't necessary it won't be a big and then there's his parents telling us that it's not necessary to file 2018 taxes cause he never made enough money but then there's also people saying tax returns are absolutely necessary. I'm at a complete loss right now. I'm still pretty young and quite unfamiliar with all this financial stuff...

One of my answer was to use the link I gave to the IRS to determine if filing is necessary. There lies your answer. If he doesn't need to file you'll have your answer. You have to trust the process.
